City of Higginsville, MO Residential Building Code

Certain documents, one (1) copy of which is on file and is open for public inspection in the office of the City Clerk of the City of Higginsville, Missouri, being marked and designated as International Residential Code, 2021 Edition, including Appendix Chapters AA, AB, AC, AE, AG, AH, AI, AJ, AN, and AP as published by the International Code Council, and is hereby adopted as the Residential Code of the City of Higginsville for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one- and two-family dwellings and townhouses, not more than three (3) stories in height above grade plane with a separate means of egress and their accessory structures, not more than three (3) stories above grade plane in height in the City of Higginsville, and providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such International Residential Code, 2021 Edition, published by the International Code Council on file in the office of the City Clerk of Higginsville are hereby referred to, adopted and made a part hereof as if fully set out in this Article.

The International Residential Code adopted by Section 510.180 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding numbers of the International Residential Code, 2021 Edition, or where there is no corresponding Section in the Code, the following Sections shall be enacted as additions to the Code.

Section R101.1. Insert: "The City of Higginsville."

Section R103, Department Of Building Safety, delete in its entirety. Refer to Section 103 of the International Building Code.

Section R105.2 Work Exempt From Permit. Under Building: Delete Item 2 "Fences."

Section R105.2 Work Exempt From Permit. Under Electrical: Add new Item 6 "A permit shall not be required for normal repair or replacement of any part which does not alter the electrical systems original approval or make it unsafe."

Add a new Section R108.2.1, Fee Schedule. The fees referred to in Section R108.2 shall be as indicated in Section 109.2 of the International Building Code.

Section R108.5, change to read: "Refunds shall be as indicated in Section 109.6 of the International Building Code."

Delete Section R110.4 in its entirety. Refer to Section 111.3 of the International Building Code for Temporary Occupancy.

Delete Section R112, refer to Appendix B of the International Building Code, 2021 Edition.

Delete Section R113.4 in its entirety. Add new Section R113.4 Violation Penalties. Any person, firm or corporation, whether as principal, owner, agent, tenant, employee or otherwise, who violates any provisions of this Chapter or violates or fails to comply with any order or regulation made hereunder, shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than five hundred dollars ($500.00) or by imprisonment not to exceed ninety (90) days, or by both such fine and imprisonment. Each day's continuance of a violation shall be deemed a separate offense.

Delete Section R114.4 in its entirety. Add new Section R114.4 as follows: Unlawful Continuance. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than fifty dollars ($50.00), nor more than five hundred dollars ($500.00), or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

Delete Chapter 11, Energy Efficiency, in its entirety. Refer to 2009 International Energy Conservation Code.

Section R403.1.1.1 is added to read as follows: Footings for basement foundation walls shall have a minimum reinforcement consisting of not less than two (2) No. 4 bars, uniformly spaced, located a minimum of three (3) inches clear from the bottom and edges of the footing.

R403.1.1.2 Column Pads. Section 403.1.1.2 is hereby added and reads as follows: Unless specified otherwise, column pads shall be a minimum of twenty-four (24) inches by twenty-four (24) inches and eight (8) inches deep. Reinforcement shall consist of a minimum of three (3) No. 4 bars each way, uniformly spaced, within each column pad.

Delete Section R303.4 Mechanical Ventilation in its entirety.

Delete Section R309.5 Fire Sprinklers in its entirety.

Delete Section P2503.5.2, Item 2, in its entirety.

Section P2503.8.2. Add new last sentence: "All testing of backflow preventers shall be by State Certified Back Flow Tester."

Add new Section P2601.2.1 Prohibited Drainage. Sanitary sewer systems shall be designed, built, and maintained in such a manner to prevent all storm or ground water from draining, discharging, or entering into the sanitary sewer system. Connection of sump pumps, foundation drains, yard drains, gutter downspouts and any other storm water draining receptacle(s) or system(s), are specifically prohibited from being connected to the sanitary sewer system.

Section P2603.5.1. Insert: "36," "36."

Section P2904.1.1: Revise first sentence to read: Sprinklers shall be considered an optional method of home protection, but when utilized shall be installed to protect all areas of a dwelling unit. See Section 510.145 of the Higginsville City Code.

Add new last sentence to Section E3406.2 Conductor Material, which reads: Where an owner is doing work on owner's personal residence, all wiring from the point of utility connection into the structure shall be of copper conductors.

Add new last sentence to Section E3601.6.2 Service Disconnect Location, which reads, "Not more than ten (10) feet of unbreakered or unfused service entrance cable shall be used inside a building without an overcurrent protected main disconnect."

24.

Delete Aluminum and Copper-Clad Aluminum conductors from Table E3603.4, AWG sizes 2/0 and smaller. Delete Aluminum Grounding Electrode conductors from Table E3603.4, AWG sizes 2 and smaller.

25.

Add new last sentence to Section E3605.5, Section E3802.3.2, and Section E3803.3, Protection Of Service Cables Against Damage, which reads: "All unbreakered or unfused service entrance conductors shall be protected by a minimum of appropriate-sized Schedule 40 PVC non-metallic conduit, from the meter enclosure to the first main disconnect enclosure, with male adapter, lock nut, and bushing to protect wire and insulation.

Add new last sentence to Section AE304.1, Permit Fees. All fees shall be figured as indicated in amended Section 109.2.1 of the International Building Code, 2021 Edition.

27.

Amend Section E3902.5, Unfinished Basement Receptacles, to read as follows: All 125-volt, single-phase, 15- and 20-ampere receptacles installed in unfinished basements shall have ground fault circuit interrupter protection for personnel. For the purposes of this Section, unfinished basements are defined as portions or areas of the basement not intended for use as habitable rooms and limited to storage area, work area, and the like.

Exceptions:

1.)	Receptacles that are not readily accessible, such as a ceiling mounted receptacle for a garage door opener.
2.)	A single receptacle supplied by a dedicated branch circuit that is located and identified for a specific use by a cord-and-plug-connected appliance, such as a refrigerator, freezer, or sump pump.
3.)	A receptacle supplying a permanently installed fire alarm or burglar alarm system.
