Pursuant to the Act of 1979, P.L. 503, No. 108,[1] the Township of Fairview (hereafter referred to as the "Township") hereby establishes the Educational Service Agency of Fairview (hereinafter referred to as the "Agency").

A. 
The Agency shall consist of three members, all of whom shall be residents of the Township of Fairview and be at least 18 years of age.
B. 
The members of the Agency shall be appointed by the Board of Supervisors for terms of three years; however, initially one member shall be appointed for one year; however, this member's term shall expire on the first day of January of the first year following his appointment; and one member shall be appointed for a term of two years; however, this member's term shall expire on the first day of January of the second year following his appointment; and one member shall be appointed for three years; however, this member's term shall expire the first day of January of the third year following his appointment.
Vacancies in the Agency occurring for any reason shall be filled by appointment by the Board of Supervisors of a successor to serve for the remainder of the term of the individual being replaced.
Members of the Agency shall receive such compensation as shall be fixed from time to time by the Board of Supervisors.
Each member of the Agency may, at the discretion of the Board of Supervisors, be required to furnish a bond, in the amount and with the surety specified by the Township for the faithful performance of a member's duties.
The Agency will have the following authority and duties:
A. 
Annually prepare a budget showing it contemplated income and its proposed expenditures for the succeeding year and shall on or before the first day of November of each year submit the budget to the Board of Supervisors for approval.
B. 
Annually adopt the budget as submitted under Subsection A of this section, as modified by the Township.
C. 
Employ, supervise and discharge special school police to direct traffic at or near schools in the Township, which police are appointed by the Township upon request of the Board of School Directors of the West Shore School District.
D. 
Supervise and control the special school police, which supervision and control shall include, but not be limited to, the following:
(1) 
Establishing, administering and enforcing rules and regulations for the work and conduct of the crossing guards or special school police;
(2) 
Establishing work schedules and designating the locations where and the time when the various individuals are to be on duty;
(3) 
Establishing position classifications as deemed necessary and designating the individuals to serve in each classification.
E. 
From monies budgeted and made available, as provided below, make all payments for the services of the special school police and, if necessary, make all other budgeted expenditures.
F. 
Receive payments by the Township (as set forth below), and any other gifts, grants, devises or bequests.
G. 
Establish a system of accounts for all monies received by it and establish one or more separate bank accounts into which all monies shall be deposited and from which all expenditures shall be made.
The Township shall transfer and pay over to the Agency the money that the Township budgeted for the Agency.
The Agency shall continue until such time as the Township by ordinance abolishes same or the Legislature of the Commonwealth of Pennsylvania repeals Act 108 of 1979[1] or by other appropriate legislation abolishes said Agency.
