A. 
There shall be the following positions which shall be filled by the First Selectman:
1. 
Building Inspector.
2. 
Emergency Management Council and Director.
3. 
Constables.
4. 
Sanitarian.
5. 
Town Attorney.
B. 
There shall be the following positions which shall be filled by the Board of Selectmen:
1. 
Assessor.
2. 
Director of Health.
3. 
Animal Control Officer.
4. 
Fire Marshals.
5. 
Regional Planning Agency Representative.
Except as otherwise provided in this chapter, the officers and offices designated in Section 701 and Section 702 shall have all of the powers and duties vested in such officers and offices prior to the effective date of this Charter and all powers and duties thereafter conferred or imposed upon such offices by the Connecticut General Statutes and the Ordinances of the Town.
A. 
The Board of Selectmen shall appoint an Assessor. This office shall have permanent status.
B. 
The powers and duties of the Assessor shall be those prescribed by the Connecticut General Statutes.
C. 
The Board of Selectmen shall appoint the Assessor from among the three highest candidates chosen on the basis of competitive examination. Said examination shall be designed to determine the technical competence, general aptitude and suitability of the applicants. The Board of Selectmen may reject any or all candidates after an examination and hold further examinations.
D. 
All such appointees shall take office on the day they are appointed and qualified and shall serve until their respective successors have been appointed and qualified, or until dismissed by the Board of Selectmen.
E. 
The Board of Selectmen may remove an Assessor for cause.
A. 
The Selectmen shall, by majority vote, at a meeting to be held no later than one month after the General Town Election, appoint a Director of Health in the manner prescribed in the Connecticut General Statutes, as amended.
B. 
The Town may enter into a contractual agreement with another municipality or municipalities to obtain public health services pursuant to the provisions of the Connecticut General Statutes, as amended.
C. 
The Director of Health may appoint such assistants as he deems necessary or desirable. No compensation shall be paid to such assistants unless compensation is approved by the Board of Selectmen.
A. 
The Town shall have a Fire Marshal and a Deputy Fire Marshal in accordance with the Connecticut General Statutes, as amended.
B. 
The Fire Marshal shall have all the powers, duties and responsibilities granted to and imposed upon local Fire Marshals by the Connecticut General Statutes, as amended. The Deputy Fire Marshal shall perform the duties of the Fire Marshal in the event of absence or disability of the Fire Marshal.
C. 
In making such appointments, preference shall be given to members of the Middlefield Fire Department.
D. 
The appointments shall be made and the appointees shall qualify and their appointments shall be recorded and reported in accordance with the provisions of the Connecticut General Statutes, as amended. Appointees shall be sworn to the faithful performance of their duties by the Town Clerk and, after being sworn in, shall continue to serve in that office until their successors have been appointed and qualified, or until dismissed by the Board of Selectmen.
A. 
The First Selectman shall appoint, and may remove, a Town Attorney, who shall be an attorney at law admitted to practice law in this State.
B. 
The Town Attorney shall be the legal advisor of the Board of Selectmen, First Selectman, and all Town offices, agencies, boards and commissions in all matters affecting the Town and shall, upon written request authorized by the First Selectman, furnish a written opinion on any question of law involving their respective powers and duties.
C. 
The Town Attorney shall appear for and protect the rights of the Town in all actions, suits or procedures brought by or against it or any of its departments, offices, agencies, boards or commissions. Upon request, the Town Attorney shall prepare or review ordinances, forms of contract, or other instruments to which the Town is a party or in which it has an interest. The Town Attorney shall have the power, with the approval of the Board of Selectmen, to appeal from orders, decisions and judgments and, subject to the approval of said Board of Selectmen, to compromise or settle any claims by or against the Town.
D. 
The Inland Wetlands, Planning and Zoning or Zoning Board of Appeals Commission, in carrying out duties and functions imposed by law, may, by majority resolution, anything in this Charter to the contrary notwithstanding, employ any licensed professional, including an attorney, to represent or advise it, provided there are sufficient funds in the Commission's budget available for such employment.
E. 
If in special circumstances the Board of Selectmen deem it advisable, it may, by resolution, provide for the temporary employment of counsel other than, or in addition to, the Town Attorney.
A. 
The First Selectman is empowered to hire that member[1] of constables which is deemed necessary by the Board of Selectmen to maintain the preservation of public peace, in accordance with the authority granted by Connecticut General Statutes to provide police protection.

B. 
The First Selectman shall also have the responsibility to train, transfer, assign duties, to promote, discipline, demote and dismiss constables for any cause. Any dismissal for just cause shall be subject to right of review by the Board of Selectmen, when requested by the constable or any member of the Board of Selectmen. The First Selectman shall also be empowered to make all rules and regulations necessary for the efficient and effective operation of the Town's Law Enforcement Department.
C. 
The constables shall have all powers and duties, not inconsistent with the provisions of this Charter, conferred or imposed by the Connecticut General Statutes on such officers and such other power and duties as may be prescribed by the Board of Selectmen.
