It is found and declared that premises owned by the Town situated westerly of and contiguous to Lake Beseck and known as Lake Beseck Beach, including but not limited to the beach area, parking area and clubhouse (the beach facilities), do not provide unlimited capacity for recreational, parking and other similar purposes. The beach facilities were acquired and have been maintained by the Town for the use of the residents and taxable property owners of the Town. The use of the beach facilities has become increasingly popular and permitting nonresidents and nontaxpayers to use the beach facilities has resulted in overcrowding and the inability of some residents and taxpayers to make use of the beach facilities, thereby defeating the purpose for which they were acquired and have been maintained. Overcrowding threatens the health, safety and general well-being of the users. Therefore, it is found and declared necessary to the health, safety and general well-being of the residents and taxpayers of the Town to restrict and limit the use of the beach facilities to the individuals referred to in § 355-2.
The use of the Lake Beseck Beach facilities shall be restricted to permanent residents, taxpayers who, jointly or severally, are liable to the Town for taxes assessed against them on an assessment of not less than $1,000 on the last completed grand list of the Town, or who would be so liable if not entitled to an exemption pursuant to § 12-81 of the Connecticut General Statutes; members of their immediate families who actually reside with the taxpayer; summer residents in the Town whose residency is at least two weeks in duration; and the guests of all of the above-mentioned people, all in accordance with such regulations as are established from time to time by the Park and Recreation Commission.
The Park and Recreation Commission shall establish and maintain a pass system governing public access to the Lake Beseck Beach facilities. The Park and Recreation Commission shall have the authority to suspend pass privileges when, after a hearing, it finds that a pass holder has willfully violated any established rules and regulations governing the use of the beach facilities. Passes shall not be issued unless the applicant presents adequate proof of his or her residence, taxpaying or other entitlement, and agrees, in writing, to abide by the rules and regulations governing the use of the beach facilities. The Park and Recreation Commission shall publish its rules and regulations concerning beach facilities and make copies of such rules and regulations available to all pass holders.
No person shall park a motor vehicle on the premises of the Lake Beseck Beach facilities unless such person possesses a valid beach facility pass or is otherwise eligible for admission to such premises pursuant to this chapter and the rules and regulations of the Park and Recreation Commission with respect thereto. Vehicles may be parked only in such areas as are designated by the Park and Recreation Commission.
