The City Planning Commission, previously created by ordinance, is hereby appointed as the Zoning Commission of Herculaneum, Missouri, as provided for in Section 89.070, RSMo., 1969.

The City Planning Commission also know as the City Planning and Zoning Commission shall have a membership consisting of nine (9) persons. Such membership shall include the Mayor, if the Mayor chooses to be a member of the Planning and Zoning Commission, a member of the Board of Aldermen selected by the Board of Aldermen, if the Board of Aldermen chooses to have a member serve and seven (7) citizen members. The Public Works Coordinator or Public Works Director or some other similar official shall be available at all Planning and Zoning meetings in order to advise the Commission but shall not be a voting member.

A. 
The citizen members of the Planning and Zoning Commission shall be appointed by the Mayor and approved by the Board of Aldermen and shall serve, without compensation, for a period of four (4) years. The terms of the seven (7) citizen members shall be staggered such that two (2) members shall serve for two (2) years, two (2) members shall serve for three (3) years and three (3) members shall serve for four (4) years. Should the Mayor choose to be a member of the Planning and Zoning Commission, the Mayor shall serve so long as he serves in the capacity as Mayor. If the Mayor chooses to be a member of the Planning and Zoning Commission then, in the absence of the Mayor, the Acting President of the Board of Aldermen, commonly referred to as Mayor Pro Tem, shall participate and perform the duties of the Mayor. In the event the Mayor does not choose to be a member of the Planning and Zoning Commission, then the Acting President of the Board (Mayor Pro Tem) shall not participate as a member of the Planning and Zoning Commission. If the Board of Aldermen chooses to have a member of the Board of Aldermen serve, then that member shall serve during the term of his membership as a member of the Board of Aldermen.

Vacancies in the membership shall be filled by appointment as provided by this Section.

Any citizen member may be removed by the Board of Aldermen for cause shown in writing and after public hearing.

The Commission shall elect from its citizen members a Chairman and a Secretary who shall serve for a term of one (1) year. The Chairman and Secretary elected from the citizen members shall be voting members.

A. 
The Commission shall hold regular meetings and such special meetings as may be called by the Chairman. The Commission shall adopt rules for the transaction of business and the conduct of meetings. Minutes of the meetings shall be recorded by the secretary and shall be a public record.
B. 
The Commission shall have the power to recommend contracts with City Planners and such other professionals as it may require, provided however that no expenditure of funds for services shall be made without prior approval of the Board of Aldermen.
C. 
The Commission shall have such duties and powers as prescribed by statute or by ordinance.
D. 
All records of the Planning and Zoning Commission, including minutes, shall be kept at City Hall.
E. 
In the event it is determined that the Planning and Zoning Commission shall meet, the Planning and Zoning Commission shall, after such meeting, set no later than thirty (30) days thereafter a follow up meeting to carry on such business as is necessary before the Planning and Zoning Commission. In the event there is no business to be carried on before the Planning and Zoning Commission, the Planning and Zoning Commission shall meet in order to approve or make necessary changes to the minutes.
