The provisions of this chapter shall not apply to the sale,
storage or display of newspapers or periodicals.
It shall be unlawful for any vendor of foodstuffs or merchandise
to store or display their wares which will in any way obstruct the
sidewalk or cartway or any portion thereof so as to prevent the free
use of the same by the general public in the Borough.
Any person, firm or corporation that intends to conduct a temporary
outdoor sale of foodstuff, plants, flowers or merchandise of any kind
in the Borough shall first secure a temporary sales permit upon written
application as prescribed by the Borough and upon payment of a permit
fee of per day in an amount as set from time to time by resolution
of the Borough Council, or any fraction thereof, and an administrative
fee as set by Borough Council.
Nonprofit organizations shall file a permit application as provided
under this chapter but shall be exempt from the payment of the permit
fee imposed.
As used in this chapter, the following terms shall have the
meanings indicated:
PERSONS
For the purpose of this chapter, shall mean individuals,
firms, unincorporated associations, partnerships, business corporations
and nonprofit corporations.
TEMPORARY PERMIT
A permit to conduct an outdoor sale for a period not in excess
of 45 days in any one calendar year which shall be conducted between
the hours of 7:00 a.m. and 9:00 p.m. only.
All rubbish, trash or debris generated by the outdoor sale shall
not be accumulated on the premises and shall be removed from the premises
and discarded by the person or entity to whom the permit was issued.
Sale or distribution of any and all incendiary products commonly
known as, but not limited to, "fireworks" shall be strictly prohibited.
Any person or persons violating any of the provisions of this chapter shall be punishable as provided in Chapter
1, Article
I, Enforcement; General Penalty, of this Code.
