There is hereby created the office
of City Attorney.

The City Attorney shall be a person
licensed to practice law in Missouri and need not be a resident of
the City of Park Hills. The Mayor shall appoint said City Attorney
with the approval of the Council and said City Attorney shall serve
at the pleasure of the Mayor and Council.

A. It shall be the duty of the City Attorney
to:
1.
Institute and conduct in the Municipal
Court all prosecutions as to any person who may violate the Park Hills
City Code or any other ordinance of the City and to represent the
City in all cases in the Municipal Court and in the Circuit Courts
and Appellate Courts of this State in which an appeal has been taken
from the Municipal Court; and
2.
Review in the first instance all
violations of the Sections of the Park Hills City Code and any other
ordinances.

A. The Mayor may appoint, with approval of
the Council, a substitute City Attorney who shall act as City Attorney
any time the appointed City Attorney is temporarily absent from the
City, sick, unable to attend any court or unable to handle any matter
due to a conflict of interest. This substitute City Attorney shall
be a person licensed to practice law in Missouri and shall serve at
the pleasure of the Mayor and Council. Said individual need not live
within the City limits of Park Hills.
B. At any time when there is no substitute
City Attorney appointed under the previous Subsection, the appointed
City Attorney, in case of his/her temporary absence from the City,
sickness, inability to attend any court or due to a conflict of interest,
with the approval of the City Administrator, may appoint some suitable
person to act in his/her stead for the occasion. Said individual need
not live within the City limits of Park Hills.
