It shall be unlawful for any owner or occupier of any building
abutting upon any of the streets, lanes or alleys of the City to permit
any awning or other projection already erected and projecting over
such street that does not comply with the provisions of the preceding
section to remain for a period of more than 30 days after due notice
from the City Council to remove the same.
On and after July 28, 1948, no balcony or other such projection
shall be erected over and above any street, alley or sidewalk within
the City. All balconies and other such structures existing on July
28, 1948, shall not be permitted to be replaced or rebuilt in the
event that the same become destroyed by fire or otherwise, or the
building is remodeled or the balcony is not kept in proper repair
or becomes a public nuisance.
It shall be unlawful and is hereby declared a nuisance for any
owner or occupier of any property abutting upon any of the streets,
lanes or alleys of the City to erect or construct or cause to be erected
or constructed any steps or other such projections which shall extend
beyond the property line and be upon any street or sidewalk in the
City without first obtaining permission of the Council for the erection
or construction of such steps or other projections.
Persons engaged in the erection, reconstruction or repair of
any building, fence or other structure may occupy the roadway and
sidewalk with building materials for such reasonable period as the
City Engineer may decide, to be specified on permits issued by the
City Engineer.
It shall be the duty of every person before entering upon the
construction of any building which shall extend to the property line
to protect the public and persons using the sidewalk in front of such
building in the process of construction by a covering or roof over
the sidewalk in front of such building. Such canopy or covering shall
be of sufficient strength to protect safely any pedestrian from falling
bricks or other debris which may fall or be thrown from such building
in the process of construction.
Material for the building or repair of any building or structure
shall not be piled or placed upon the sidewalk, but shall be laid
along and outside of the curb in the roadway with sufficient space
for the water to pass under the same in the gutter. Such material
shall be put in compact piles, lumber to be placed lengthwise along
the street and stone and brick so piled as to have the longest side
running with the street. This privilege shall be so exercised as to
leave 2/3 of the street unobstructed for the passage of vehicles.
Any person occupying a street or sidewalk with materials shall
place lights thereon in such a manner as to warn the public of the
obstruction of the roadway or sidewalk and show distinctly the clear
passage left in the roadway or sidewalk.
