Any person who shall violate any provision of this Code shall, upon conviction of such violation, be subject to a penalty which, unless otherwise specifically provided for therein, shall be as follows:
A. 
First offense penalty. Any person who shall violate any provision of this Code subject to a penalty shall, upon conviction thereof, forfeit not less than $1 nor more than $500, together with costs of prosecution.
B. 
Second offense penalty. Any person who shall be convicted of violating the same provision of this Code two or more times within one year shall, upon conviction thereof, forfeit not less than $100 nor more than $1,000, together with costs of prosecution.
A. 
The penalty provided in this chapter shall be applicable to every chapter of this City Code the same as though it were a part of each and every separate chapter unless otherwise indicated. Any person convicted of a violation of any chapter of this City Code where a duty is prescribed or obligation imposed, or where any action that is of a continuing nature is forbidden or is declared to be unlawful, shall be deemed guilty of a civil offense. A separate offense shall be deemed committed upon each day such duty or obligation remains unperformed or such act continues, unless otherwise specifically provided in this City Code.
B. 
In all cases where the same offense is made punishable or is created by different sections or chapters of this City Code, the prosecuting officer may elect under which to proceed; but not more than one recovery shall be had against the same person for the same offense; provided, that the revocation of a license or permit shall not be considered a recovery or penalty so as to bar any other penalty being enforced.
C. 
Whenever the doing of any act or the omission to do any act constitutes a breach of any chapter or provision of this City Code and there shall be no forfeiture or penalty specifically declared for such breach, the provisions of this chapter shall apply.
D. 
Whenever in this Code any state statute or administrative regulation has been referred to or adopted by reference, such reference or adoption shall include all amendments and revisions to the statute or Code subsequently adopted, approved and enacted.
No provision of this City Code designating the duties of any officer or employee shall be so construed as to make such officer or employee liable for any forfeiture or penalty for a failure to perform such duty, unless the intent of the City Council to impose such forfeiture or penalty on such officer or employee is specifically and clearly expressed in the section creating the duty.
