No person, firm or corporation shall raise, keep, harbor or slaughter any fowl, including but not limited to chickens, ducks, geese, pigeons or turkeys within the City.
A. 
Exceptions.
(1) 
The keeping of up to and including six hens shall be allowed per tract of land, excluding tracts of land containing multifamily dwellings.
(2) 
The slaughtering of hens shall be permitted inside a garage or other building on site and shall be limited to those hens specified by this § 464-2.
B. 
License required.
(1) 
An annual license to keep hens in the City of Englewood is required. License renewal will be granted if the Department of Health receives no complaints regarding the permit holder's keeping of chickens. The permit will be presumptively renewed upon payment of the applicable permit fee, and the licensee may continue to keep chickens under the terms and conditions of the initial permit. The Department of Health may revoke the permit at any time if the licensee does not comply with the terms of the permit.
(2) 
The Health Officer of the City of Englewood shall act upon such application based upon the standards set forth in this section within 30 days of the date of application. The applicant shall have the right to appeal an adverse action to the Board of Health. The appeal shall be filed with the Board of Health within 10 days of the adverse action and shall be in a form prescribed by the Board of Health.
(3) 
License period; license fee. The license period shall be from January 1 through December 31 of each year. The annual license fee to keep hens is set forth in Chapter 485, Fees and Fee Schedule.

C. 
Regulations.
(1) 
All hens shall be confined in coops, and outdoor enclosures containing hens shall be located outside of, and completely apart from, any building used wholly or in part for dwelling purposes, or as a food or eating establishment, or in which people congregate. Coops and outdoor enclosures containing hens shall be kept no less than 25 feet from the door or window of any dwelling or occupied structure, other than the owner's dwelling, unless the written consent of the owner(s) of the property affected by such set back has been obtained.
(2) 
The coop and outdoor enclosure shall be kept in a clean and sanitary condition.
(3) 
All chicken feed, when not in use, shall be stored in a metal or plastic container fitted with a cover. Chicken feed shall be dispensed from a suitable feeding trough, or similar container, and not scattered about the coop or outdoor enclosure.
D. 
Applicability of this title. The provisions of this article shall not apply to the keeping of live chickens for sale or for the preparation for sale.
E. 
Prohibitions.
(1) 
No person shall keep roosters.
(2) 
No live chicken shall be permitted to fly or run at large.
(3) 
No poultry food shall be scattered about any premises.
