The Town Board of the Town of Wilna, pursuant to the authority
granted it under Article 48-c of the Vehicle and Traffic Law of the
State of New York and §§ 10 and 20 of the Municipal
Home Rule Law, hereby enacts as follows.
The Town Board of the Town of Wilna has been requested to open
all roads in the Town of Wilna to the use of ATVs. It appears from
examination of the roads requested that there are no safety issues
and that prior use of Town roads by ATVs have not caused any problems.
Further, the expansion of existing trails necessitates the need for
expansion and use of Town roads at this time in order to access those
trails. It is the purpose of this article to provide the use of all
Town roads by all terrain vehicles.
Pursuant to § 2405 of the Vehicle and Traffic Law,
all Town highways shall be designated as open for ATV traffic.

The Town Board of the Town of Wilna, pursuant to the authority
granted it under Article 4 of the Town Law and §§ 10
and 20 of the Municipal Home Rule Law, hereby enacts as follows.

Provisions, Art. I)]
The Town Board of the Town of Wilna hereby finds that it is
the owner of a certain property known as the former Town of Wilna
Landfill. This landfill was initially closed in the early 1990s. A
local law known as Local Law No. 2 of 1992 was adopted to restrict
access to the site for safety reasons. In the 16 years since the adoption
of that law, the landfill site has been successfully closed and all
monitoring of the site has been completed in accordance with DEC regulations.
While a portion of the site is fenced for safety purposes, the remaining
portion of the site is currently in a safe condition. The Board has
been approached to open this property outside of the fenced area for
use by snowmobiles and ATVs. The Board finds that such use is appropriate.
Should any sections or provisions of this article be declared
invalid, such decision shall not affect the validity of the remaining
portions of this article.
