There is hereby established a Historic Preservation and Design Review Advisory Committee for the Township of Plumsted.

The Historic Preservation and Design Review Advisory Committee shall serve in an advisory capacity with responsibilities including, but not limited to, reviewing the proposed actions to historically significant properties throughout the Township and assist in the land use and planning decision making process.

The members of the Historic Preservation and Design Review Advisory Committee shall be appointed and serve at the pleasure of the Township Committee for a one (1) year term commencing January 1st to December 31st. The members shall consist of two (2) representatives from the Planning/Land Use Board; two (2) representatives from the New Egypt Main Street Design Committee; two (2) representatives from the New Egypt Historical Society; one (1) member from the Plumsted Business Merchants Association; one (1) member from the Township Committee; and the Construction Code Official. The Historic Preservation and Design Review Advisory Committee may form and appoint, from its duly authorized membership, members to subcommittees to effectuate the purpose of this ordinance.

The Township Committee hereby adopts, by reference, the Plumsted Township Historic Properties Map dated August 23, 2007 and as amended, as set forth in the Historic Preservation Plan of the adopted Master Plan.

Applicants for demolition permits within the Township for any building that is listed on a Historic Sites Inventory adopted into the Master Plan by the Land Use Board shall consult with the Historic Preservation and Design Review Advisory Committee regarding historic preservation alternatives to demolition. The Historic Preservation and Design Review Advisory Committee shall provide such suggestions or recommendations to the applicant in writing within thirty (30) days of receipt of the submission. Demolition permits may be issued if the owner of such a building can demonstrate:
A. 
A hardship related to the physical constraints or condition of the building; or
B. 
An imminent threat to the public health and safety due to the condition of the building and
C. 
No reasonable historic preservation alternatives to demolition are feasible.
In the event of a determination of an imminent public safety hazard by the Construction Official, the provisions of this section shall be waived to enable the immediate demolition and elimination of the hazard.
Pursuant to Chapter 6, Section 4 D, entitled Demolition permit fees. Permit fees for demolition of or the removal of a building or structure is a flat fee. This fee varies according to type of structure and whether or not there has been a condemnation as set forth herein. This fee may be waived if the owner makes the structure available to the local fire department for training purposes and thereafter within forty-eight (48) hours of termination of use of the structure by the local fire department has the structure razed. The local fire department shall indemnify and hold harmless the Township and the owner from any liability. No building debris or demolition material shall be permanently deposited on site but all demolition material and debris shall be disposed of in accordance with applicable solid waste disposal laws and regulations.

All applications to the Plumsted Township Land Board that contain properties identified on the official Plumsted Township Historic Sites Inventory Map dated August 23, 2007 and as amended, shall be subject to review and comment and recommendations from the Plumsted Township Historic Preservation and Design Review Advisory Committee prior to any official action by the Land Use Board.

All applicants for signage permits within the C-4 zone shall seek suggestions and guidance from the Historic Preservation and Design Review Advisory Committee prior to the submission of a final development application for approval by the Land Use Board or prior to obtaining a waiver from the Township Engineer. The Historic Preservation and Design Review Advisory Committee shall provide such suggestions or recommendations to the applicant within fourteen (14) days of receipt of the submission.
