Recreational uses located within the HC-1, HC-2 and HC-3 Zones
(Highway Commercial) permitted either by right or by variance and
which seek to remain open beyond normal business hours must seek a
one-day permit from the Township Council (hereinafter the "permit").
Permits may only be issued for events sponsored by governmental or
not-for-profit 501(c)3 entities. A recreational facility may apply
for no more than 14 such permits in any calendar year. Any recreational
facility operating on such a permit shall be required to have a special
or regular duty East Brunswick police officer assigned to the location.
All costs and expenses of the special or regular police officer at
the recreational facility shall be paid to the Township by the applicant
for the permit. The permit request for extended hours may be denied
by the Township Council upon a demonstration of good cause by any
interested person or persons. If alcohol is permitted on the recreational
facility's premises, it cannot be sold, served or consumed after 12:00
midnight even if the business is permitted to remain open.
The municipal officers and/or agencies designated to enforce
the provisions of this article in accordance with due process of law
are the East Brunswick Police Department.
Any person who violates any provision of this article shall,
upon conviction thereof, be punished by a fine not to exceed $1,000
or by imprisonment for a term not to exceed 90 days, or both. A separate
offense shall be deemed committed on each day during or on which a
violation occurs or continues.
The recreational facility shall apply for the permit through
the East Brunswick Clerk's office, using the application form provided
by the Clerk. The application form shall, at a minimum, require the
following information: the name and address of the recreational facility,
contact information for the recreational facility personnel responsible
for supervising the after-hours event, the name and address of the
sponsor, contact information for the sponsor's personnel responsible
for supervising the after-hours event, proof that the sponsor is a
governmental or not-for-profit 501c(3) entity, hours of operation
requested, and date of event. The recreational facility shall pay
a permit fee of $250 to the Township upon submitting the permit application.
This application fee shall be nonrefundable.
