The Township of Montague is committed to the safety of its employees and the general public. Persons who are under the influence of alcohol or drugs while working pose a serious safety and health risk to themselves, to other employees, and to the general public.
A. 
All employees are subject to reasonable cause and post-accident testing for illegal drug use/alcohol intoxication. Other state and Federal laws that may apply to drug/alcohol testing, such as the commercial driver's license ("CDL") drug and alcohol testing provision, will apply to Township of Montague employees affected by the laws. CDL employees may be subject to random testing as required by Federal law.
B. 
All potential employees offered a position by the Township of Montague that requires a CDL license must submit to a drug/alcohol test as a condition of employment.
C. 
An employee must not consume alcohol while on duty, or within four hours prior to duty time, and within eight hours following a motor vehicle accident while on duty or until the employee undergoes a post-accident test, whichever occurs first.
D. 
More detailed provisions implementing these policies may be by inclusion in the Township personnel manual.
A. 
Before an employee is ordered to submit to a drug or alcohol test, his or her department head or the Township Clerk shall prepare a confidential report that documents the basis for reasonable suspicion or, in the case of an accident, specifies the accident. This report may be as brief or as lengthy as necessary and shall be submitted to the Township Committeeperson responsible for Personnel ("Personnel Director"). The Personnel Director shall be responsible for the decision to order a test based on the contents of this confidential report.
B. 
Every employee or potential employee has the option to complete a medical questionnaire which clearly describes all medications, whether prescribed by a physician or available over-the-counter (nonprescription), which the employee or potential employee ingested during the prior 30 days.
A. 
Urine samples shall be ordered from a Township employee when there exists reasonable evidence that the actions, appearance or conduct of the employee are indicative of drug or alcohol abuse. Urine samples shall not be ordered from an employee unless approved by the Personnel Director.
B. 
Urine samples shall be ordered from all potential employees offered a position requiring a CDL license by the Township of Montague.
C. 
The Township will contract with a company to administer the Township's drug/alcohol program, which will be responsible for the collection and testing of samples, including the location of where a sample is to be collected, and which will use such screening equipment and protocols recognized as appropriate for the testing.
D. 
All testing procedures will be conducted in accordance with Federal regulations controlling drug and alcohol procedures for transportation and the workplace. At the time that the urine sample is provided, the employee or potential employee will have the option to have his or her sample "split." Part of the sample is to be tested, the remainder to be reserved for later confirmation testing if required by the employee or potential employee. Urine samples will be processed in accordance with accepted chain of custody procedures, and every effort will be made to ensure that the identity of the employee or potential employee being tested is kept confidential. Throughout the urine acquisition process, the sample will be identified by use of the last four digits of the social security number of the employee or potential employee. No form forwarded to the laboratory will contain the name of the employee or potential employee.
The test administrator will notify the Personnel Director of the results of the analysis immediately upon completion. The administrator is to report as positive only those samples which have been confirmed to be positive for the presence of illegal drugs or alcohol. The administrator will follow up all immediate notifications with written reports. The Personnel Director will notify the employee or potential employee of the results of the analysis as soon as possible after notification by the laboratory. The Personnel Director will provide a copy of the laboratory report to the employee or potential employee if the employee requests it.
Any employee who tests positive or refuses to provide a urine sample will be subject to dismissal or other disciplinary action. Any employee who tests positive may be required as a condition of continued employment to participate in an approved substance abuse rehabilitation program. Any potential employee who tests positive or refuses to provide a urine sample will not be granted employment by the Township of Montague.
