As used in this chapter, the following terms shall have the meanings indicated:
USED CAR SALES LOT
A lot or tract of land upon which is located two or more used automobiles which are for sale to the general public.
No person, persons, firm, partnership or corporation shall maintain a used car sales lot in the Township of Montague, Sussex County, New Jersey, without first obtaining a license from the Township of Montague as herein provided. The Township Committee of said township shall be the licensing authority to grant said licenses.
A. 
An application for a license shall be made in writing and presented to the Township Clerk for filing at least one week before a regular meeting of the Township Committee.
B. 
The application shall contain a sketch plat of the property to be licensed at a scale of not less than one inch equals 100 feet. Said sketch plat shall show the proposed location of cars, all lanes and roadways, entrances, fences and buildings.

The license fee shall be $350 per annum, and a certified check for said fee shall accompany the license application. The date of renewal for said license shall be May 1 of each year.
The applicant for a license shall publish a notice of intention to apply for said license in a newspaper which has a general circulation in the Township of Montague. Said notice shall be published at least once, and said notice shall be published at least five days before the Township Committee meeting when the application is initially offered. Proof of publication must be submitted to the Township Clerk before or at said meeting.
A notice of intention to apply for a license hereunder shall be given to all landowners within 500 feet of the premises to be licensed. Said notice must be given at least five days before the Township Committee meeting when the application is initially offered. Proof of said notice must be submitted to the Township Clerk before or at said meeting.
All applicable regulations of the New Jersey Department of Motor Vehicles pertaining to the operation of used car lots must be strictly adhered to.
All automobiles in a used car lot shall be arranged and displayed in rows and have roadways between each double row of cars at a width of at least 20 feet to permit the movement of fire-fighting equipment. There shall also be lanes of a like width around the outside perimeter of the licensed premises. There need be no lane on the road side so long as there are no cars parked within the right-of-way line of the road upon which the lot faces. Said right-of-way widths shall be presumed to be as set forth on the Montague Township Tax Map.
All used car sales lots shall be maintained in a clean, sanitary and orderly condition at all times.
The license for a used car sales lot shall be conspicuously displayed at all times.

The Building Inspector and/or Code Enforcement Officer of Montague Township are hereby designated the enforcing authority for this chapter and they are to have the authority to go upon the licensed premises at any time during the hours of 8:00 a.m. and 6:00 p.m., Monday through Saturday of any week for inspection of the licensed premises.

A violation of any of the provisions of this chapter shall be grounds for a revocation, after notice of hearing, of the license by the Township Committee.
The penalty and revocation provisions of this chapter shall not be deemed the sole remedy for violations of this chapter, and there is specifically granted the additional remedy of injunction if the facts of the case permit same according to the laws of the State of New Jersey.

Any person, persons, firm, partnership or corporation who shall violate any provision of this chapter or participate or assist in such violation shall, upon conviction before a court of jurisdiction, be subject to a fine not to exceed $500 or imprisonment in the county jail for a period not to exceed 90 days, or both.
