"Fireworks," which shall be defined as any substance, or combination of substances, or article prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation, and shall include blank cartridges, toy pistols, toy cannons, toy canes or toy guns in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, roman candles, skyrockets, sparklers or other devices of like construction and any device containing any explosive or flammable compound, or any tablets or other devices containing any explosive substance, except that the term shall not included auto flares, paper caps containing not in excess of an average of 0.25 grain (16.2 mg) of explosive content per cap, and toy pistols, toy canes, toy guns or other devices for use of such caps, shall not be discharged within the corporate limits of the Borough of Green Lane unless the person who seeks to discharge the fireworks first obtains from the Borough Secretary for such cost as may from time to time be established by Borough Council a permit for such discharge.
Application for permits to discharge fireworks shall be made in writing to the Borough Secretary at least 15 days in advance of the date of the display or discharge of fireworks. Such application shall be accompanied by a check drawn to the order of the Borough of Green Lane in the amount of the Borough's charge for issuance of the permit, a plot plan indicating the site where the fireworks are to be discharged in relation to surrounding buildings and streets and a bond or certificate of insurance in an amount to be determined by the Fire Marshal, but in no instance less than $100,000, for the payment of all damages which may be caused either to a person or persons or to property by reason of the permitted display, and arising from any acts of the permitter, the permitter's agents, employees or subcontractors.
No fireworks, as herein defined, may be discharged, nor will the Borough issue a permit granting to an applicant the right to discharge fireworks, at a location within 100 feet of any Borough street, alley, roadway or land or within 100 feet of any inhabited building. The distances set forth herein are to be considered as minimum setbacks and shall not be considered as being restrictive upon the Fire Marshal, who may require more significant setbacks in particular instances.
Any person or persons, partnership, association or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, plus costs, and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days.
