Parking meter zones are hereby established on the following
streets or portions thereof, as follows:
A. Zone No. 1: Lehigh Street, from S. 20th Street to S. 21 St. Street,
both sides. Lehigh Street from S 21st Street to S 22nd Street, south
side. Lehigh Street, 2200 block, both sides.
B. Zone No. 2: Fairview Avenue, from 20th Street to 22nd Street, both
sides.
C. Zone No. 3: S. 20th Street, from Washington Boulevard to Ferry Street,
both sides.
D. Zone No. 4: S. 21st Street, between Washington Boulevard and Lehigh
Street, west side. S. 21st Street from Fairview Avenue to Ferry Street,
east side.
E. Zone No. 5: S. 22nd Street from Fairview to Washington Boulevard,
west side.
Parking in any of the aforesaid parking meter zones is hereby
limited to a period of time not exceeding three hours at any time
between the hours of 9:00 a.m. and 9:00 p.m. Monday through Sunday.
In all parking meter zones, a parking meter bearing instruction
shall be installed for every parking space. All such spaces shall
be plainly designated by marked lines upon the street and may be placed
either parallel, diagonal, or perpendicular to the curb.
Every vehicle parked in any parking meter zone shall be entirely
within the line of designated parking space with the front end of
such parked vehicles at or immediately adjacent to the parking meter
controlling such parking space.
The coins required to be deposited in parking meter as aforesaid,
are hereby levied and assessed as fees to provide for the proper regulations
and control of traffic upon the streets in Wilson Borough, including
the cost of supervision and regulating the parking of vehicles in
the aforesaid zones created hereby and the cost of purchase, supervision,
protection, inspection, installation operation, maintenance, control
and use of the aforesaid parking meters. The coins so deposited in
said parking meters shall be collected and accounted for under the
direction of the Chief of Police and shall by him or his designee
be deposited at least once every three weeks in the financial institution
designated by the Borough Manager.
No person shall deposit or cause to be deposited in any parking
meter any slug, device or metallic substitute for the required legal
coins of the United States.
No person shall open, deface, injure, tamper with or willfully
break, destroy or impair the usefulness of any parking meter installed
by authority of the Council of the Borough.
Nothing in this chapter shall be construed as prohibiting the
Borough Council, from providing free parking space for loading or
unloading of commercial vehicles, for bus stops, for taxicab stands,
or for any other matters of a similar nature, nor from establishing
additional parking zones.
The duty of enforcing the provisions of this chapter shall be
upon the Mayor of the Borough acting through the Department of Police.
In case of emergency, any of the provisions of this hereof may be
temporarily suspended by the Mayor, who acting directly or through
the Chief of Police, shall have the authority to adopt and enforce
such other temporary rules and regulations as traffic conditions during
such emergency may require.
It shall be the duty of the police officers of the Borough or
meter personnel, acting under instructions issued by the Chief of
Police, to deposit appropriate stub or violation tickets in a properly
designated receptacle to be maintained in the police department. Such
stub or violation ticket shall disclose the following information:
A. The number of each parking meter which indicates that the vehicle
occupying the parking space adjacent to or controlled by such meter
is or has been parked in violation of any of the provisions of this
chapter.
B. The state license number of such vehicle.
C. The day and hour at which time such vehicle is or was parked in violation
of any of the provisions of this chapter at the time of inspection.
D. Any other essential facts describing the circumstances pertaining
to such violation.
E. Every police officer or member of the meter department, discovering
any such violation, shall also place on such vehicle a written or
printed notice to the owner or operator thereof that such vehicle
has been parked in violation of the provisions of this chapter and
directing such owner or operator the procedure in which to make payment.
The owner or operator shall submit payment within the time designated,
and submit such violation ticket to the Wilson Borough Police Department.
The failure of such owner or operator to make such payment shall render
said owner or operator subject to the penalties hereinafter. The Chief
of Police or his designee, receiving payment of such penalty shall
issue a written receipt for payment, keep a duplicate thereof and
shall forthwith transmit all monies so received to the Borough Manager.
Any person violating any provision of this article is subject to a penalty of a fine specified in §
162-51, Fees.
