This article promotes the health, safety, and general welfare
of the residents of the Borough of Newfield, advances the safe movement
of traffic within the Borough, and eliminates obstacles or impediments
which may hinder or obstruct Borough Department of Public Works employees
from clearing snow from the streets.
The Chairman of the Road Department or his or her designee is
authorized to order the removal of all vehicles parked on Borough
streets covered by snowfall and relocated to private property in accordance
with this article.
The Chairman of the Road Department or his or her designee is
authorized to place signage on any Borough street advising that parking
is prohibited when such street is covered by snow and that any vehicles
which remain shall be subject to removal in accordance with this article.
On any street within the Borough not marked with signage advising
that parking is prohibited when the street is snow covered, notice
to owners to remove their motor vehicles parked on such snow-covered
streets shall be in writing and served upon the vehicle owner or lessee
personally or at the residence of the vehicle owner to a person 18
years of age or older. The individual effectuating notice shall prepare
an affidavit of service stating the circumstances by which service
was accomplished in accordance with this chapter. Upon receiving notice,
the owner or lessee shall remove the vehicle from the snow-covered
street as soon as possible. The owner or lessee, for purposes of this
article, shall be deemed to include a person who has custody or control
over a vehicle ordered for removal.
Diligent attempts by the Road Department to provide notice to
a vehicle owner or lessee that their vehicle is unlawfully parked
when a road is snow covered that are ultimately unsuccessful, due
to either the absence or unavailability of the owner and/or a mechanical
defect preventing relocation of the vehicle, shall constitute notice
to an owner or lessee to remove their vehicle.
Any unoccupied vehicle parked in violation of this article shall
be deemed a nuisance and a menace to the safe and proper regulation
of traffic within the Borough. The Police Department shall impound
such vehicles in accordance with Police Department procedures. The
expenses of towing and impoundment shall be borne by and be the responsibility
of the owner or lessee of the vehicle. An owner may not regain possession
of their vehicle until such costs have been paid.
Any person convicted of violating any provision of this article
shall be liable for a fine of not less than $50 nor more than $75,
a fine in an amount not less than $75 nor more than $150 for a second
violation, and a fine in an amount not less than $150 nor more than
$250 for a third or any subsequent violation; and/or a period of community
service not to exceed 10 days. Official notice or service of a summons
in prosecution, or in any other manner provided by this chapter, for
any violation of this chapter shall constitute a separate violation
for each day the violation continues after such service.
