The Springfield Fire Company shall initiate user fees for the
delivery of Fire and Rescue Services, personnel, supplies and equipment
to the scene of motor vehicle accidents and other incidents on the
highways. The rate of user fees shall be that which is usual, customary
and reasonable, which may include any services, personnel, supplies
and equipment, and with baselines established by addendum to this
article.
The user fee shall be filed with the motor vehicle insurance
carrier, representing an added-on cost of the claim for damages of
the vehicles, property and/or injuries. In the event services are
required relating to utilities causing safety problems to highway
areas, and if the area is deemed unsafe by emergency responders, the
same billing process shall apply to said utility whose equipment-related
problems cause an emergency services response. The claim's costs
shall be filed with the insurance carrier of the owner of a vehicle,
property or other responsible party.
The Springfield Fire Company Board of Directors may make rules
or regulations, not consistent with this section, as they may deem
necessary or expedient in respect to billing for these fees or the
collection thereof.
All amounts collected as a result of this article shall be placed
into a fund as established by the Springfield Fire Company to be used
exclusively for personnel, supplies and equipment of Fire and Rescue
Services.
It is found and determined that all formal actions of this Board
of Commissioners concerning and relating to the adoption of this article
were adopted in open meetings of this Township, and that all deliberations
of this Township and any of its committees that resulted in such formal
actions were in accordance with all legal requirements and the Codified
Ordinances of Springfield Township.
Any and all ordinances and/or resolutions, or parts thereof,
conflicting herewith are repealed insofar as the matters herein are
affected.
The provisions of this article are severable, and if any clause,
sentence, subsection or section hereof shall be adjudged by any court
of competent jurisdiction to be illegal, invalid or unconstitutional,
such judgment or decision shall not affect, impair or invalidate the
remainder but shall be confined in its operation and application to
the clause, sentence, subsection or section rendered. It is hereby
declared the intent of the Board of Commissioners that this article
would have been adopted if such illegal, invalid, or unconstitutional
clause, sentence, subsection, or section had not been included therein.
This is effective 90 days following final adoption by the Board
of Commissioners and publication as required by law, and shall remain
in effect hereafter until revised, amended, or revoked by action of
the Board of Commissioners of the Township of Springfield.
