It is determined and declared to be necessary and conducive to the protection of the public health, safety, welfare, and convenience of the Village of Indian point to have the DPW collect charges from all users who contribute wastewater to the Village of Indian Point's Jake Creek Trail Treatment Works. The proceeds of such charges so derived will be used for the purpose of operating, maintaining, and retiring the debt for said Public Wastewater Treatment Works.

Unless the context specifically indicates otherwise, the meaning of terms used in this Chapter shall be as follows:
"BOD" (denoting Biochemical Oxygen Demand)
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five (5) days at twenty degrees Celsius (20° C.), expressed in milligrams per liter (mg/l).
NORMAL DOMESTIC WASTEWATER
Wastewater that has a BOD concentration of not more than two hundred eighty-seven (287) mg/l and a suspended solids concentration of not more than one hundred eighty-five (185) mg/l.
OPERATION AND MAINTENANCE
All expenditures during the useful life of the treatment works for materials, labor, utilities, and other items where are necessary for managing and maintaining the treatment works to achieve the capacity and performance for which such works were designed and constructed.
REPLACEMENT
Expenditures for obtaining and installing equipment, accessories, or appurtenances which are necessary during the useful life of the treatment works to maintain the capacity and performance for which such works were designed and constructed. The term "operation and maintenance" includes replacement.
RESIDENTIAL CONTRIBUTOR
Any contributor to the Village of Indian Point treatment works whose lot, parcel of real estate, or building is used for domestic dwelling purposes.
COMMERCIAL CONTRIBUTOR
Any contributor to the Village of Indian Point treatment works whose lot, parcel of real estate, or building is not used for domestic dwelling purposes.

TREATMENT WORKS
Any devices and systems for the storage, treatment, recycling, and reclamation of municipal wastewater, domestic wastewater, or liquid industrial wastes. These include interceptor sewers, outfall sewers, sewage collection systems, individual systems, pumping, power, and other equipment and their appurtenances; extensions, improvements, remodeling, additions, and alterations thereof; elements essential to provide a reliable recycled supply such as standby treatment units and clear well facilities; and any works including site acquisition of land that will be an integral part of the treatment process or is used for ultimate disposal of residues resulting from such treatment including land for composting sludge, temporary storage of such compost, and land used for storage of treated wastewater in land treatment systems before land application; or any other method or system for preventing, abating, reducing, storing, treating, separating, or disposing of municipal waste or industrial waste, including waste in combined storm water and sanitary sewer systems.
USEFUL LIFE
The estimated period during which the treatment works will be operated.
USER CHARGE
That portion of the total wastewater service charge which is levied in a proportional and adequate manner for the cost of operation, maintenance, and replacement of the Wastewater Treatment Works.
WATER METER
A water volume measuring and recording device, furnished and/or installed by the DPW or furnished and/or installed by a user and approved by the DPW.

A. 
The user charge system shall generate adequate revenues to pay costs of annual operation and maintenance, including replacement, and costs associated with debt retirement of capital associated with financing the treatment works which the DPW may by its rules and regulations designate to be paid by the user charge system. That portion of the total user charge which is designated for operation and maintenance including replacement of the treatment works shall be established by this Chapter.
B. 
That portion of the total user charge collected which is designated for the operation and maintenance including replacement purposes, as established in Section 705.040, shall be deposited in a separate non-lapsing fund known as the Operation, Maintenance, and Replacement Fund and will be kept in two (2) primary accounts as follows:
1. 
The Operation and Maintenance Account shall be an account designated for the specific purpose of defraying operation and maintenance costs excluding replacement of the treatment works. Deposits in the Operation and Maintenance Account shall be made monthly from the operation and maintenance revenue.
2. 
The Replacement Account shall be an account designed for the purpose of ensuring replacement needs over the useful life of the treatment works. Deposits in the Replacement Account shall be made monthly from the replacement revenue.
C. 
Fiscal year-end balances in the Operation and Maintenance Account and the Replacement Account shall be carried over to the same accounts in each subsequent fiscal year, and shall be used for no other purposes than those designated for these accounts. Monies which have been transferred from other sources to meet temporary shortages in the Operation Maintenance and Replacement Fund shall be returned to their respective accounts upon appropriate adjustment of the user charge rates for operation, maintenance, and replacement. The user charge rate(s) shall be adjusted such that the transferred monies will be returned to their respective accounts within the fiscal year following the fiscal year in which the monies were borrowed.

A. 
The village shall charge and collect a user charge for the use of services rendered by the Jake's Creek Trail Wastewater Treatment Facility and main lines connected to it (hereafter, "Sewer System"), from the owners or occupants of each residence, building or structure which is connected with the Sewer System of the Village or which discharges sewage, industrial wastes, water or other liquids, either directly or indirectly, into the Sewer System of the Village. In addition, each property owner is ultimately responsible for any tenant's unpaid bills for DPW Sewer System usage.
B. 
User Charge.

1. 
Effective January 15,2024, residential users shall be charged forty-five dollars and thirty-six cents ($45.36) per sewer connection, per month.
2. 
Non-residential users without water meters, including lodging facilities but excluding 680 Jakes Creek Trail and Crowne View Resort, shall be charged a base rate of four dollars and eighteen cents ($4.18) per occupant (defined as the maximum occupancy rating as determined by Southern Stone County Fire Department) per month, with the payment obligations as set forth in Subsections (C) and (D) hereinbelow.
3. 
680 Jakes Creek Trail shall follow the same base rate of other lodging facilities on the Jakes Creek Wastewater Facility of four dollars and eighteen cents ($4.18) per occupant (defined as the maximum occupancy rating as determined by Southern Stone County Fire Department) per month.

4. 
Within the Crowne View designated area as (described in Exhibit A),[2] which is a legal description of the land owned by Crowne View, the rate shall be twenty-six dollars and three cents ($26.03) per one thousand (1,000) gallons of water usage.

C. 
Any user which discharges any toxic pollutants which cause an increase in the cost of managing the effluent or the sludge from the Jake's Creek Trail Sewer System, or any user which discharges any substance which singly or by interaction with other substances causes identifiable increases in the cost of operation, maintenance, or replacement of the treatment works, shall pay for such increased costs. The charge to each user shall be determined by the responsible sewer plant operating personnel and approved by the Village.
D. 
The user charge rates established in this Chapter apply to all users of the Village of Indian Point's Jake's Creek Trail Sewer System, regardless of the user's location.
E. 
Billing; Late Payment.
1. 
All users shall be billed monthly for the previous month. The full balance is due on the 10th, and a late fee will be applied after the 15th of the month in which the bill is issued. Bills are usually issued on the 1st of each month.
2. 
The payment is considered delinquent after the 15th day of the billing month. A fee of ten dollars ($10.00) for residences and fifty dollars ($50.00) for commercial will be added to the bill after the 15th of said month. Thereafter, there shall accrue interest at the rate of three percent (3%) per month until the account balance is zero. If an insufficient payment was received previously all future payments must be made by money order or certified check.
F. 
Review And Revision Of Rates; Notification.
1. 
The Board of Trustees of the Village of Indian Point shall review the user charge system at least annually and revise user charge rates as necessary to ensure that the system generates adequate revenues to pay the costs of the operation and maintenance of the Sewer System including but not limited to the Wastewater Treatment Facility replacement costs among users and user classes.
2. 
The Board of Trustees will notify each user at least annually, in conjunction with a regular bill, of the rate being charged for the operation and maintenance including replacement cost of operating the Wastewater Treatment Facility.

A. 
All residential and commercial structures which are completed and habitable after January 1, 2023, may be allowed to connect to the project Wastewater Treatment System, if the DPW makes a determination that there is existing treatment capacity in the system, and if the following conditions are met:
1. 
The owner of record installs a septic tank at his/her own cost which meets the project engineering specifications and which is suitable for use in connecting the structure to the collection system, and submits to the inspection provisions set forth in Subsection (A) above; and
2. 
The owner of record pays the DPW for the effluent pump and its installation, the installation of the service line from the septic tank to the main collection line, and the installation of a separate electric meter for the effluent pump; and
3. 
The owner of record will be billed by the DPW for these costs and will not be allowed to complete connection to the Wastewater Treatment System until all costs are paid in full, and the owner of record agrees that the cost of the electricity for the operation of the effluent pump will be added to the monthly user charge.
