The resolutions and regulations of the Collier Township Municipal Authority ("Authority") of a general and permanent nature adopted by the Authority, as revised, codified and consolidated into chapters and sections by General Code LLC, and consisting of Chapters SD1 through SD260, are hereby approved and enacted as the "Manual of the Collier Township Municipal Authority," hereinafter known and referred to as the "Manual."
This resolution and the Manual shall supersede all other general
and permanent resolutions and regulations enacted prior to the enactment
of this Manual, except such resolutions and regulations as are hereinafter
expressly saved from repeal or continued in force.
This resolution shall take effect immediately upon adoption.
Any and all additions, amendments or supplements to the Manual,
when passed and adopted in such form as to indicate the intent of
the Authority to make them a part thereof, shall be deemed to be incorporated
into such Manual so that reference to the "Manual of the Collier Township
Municipal Authority" shall be understood and intended to include such
additions and amendments.
It shall be unlawful for anyone to improperly change or amend,
by additions or deletions, any part or portion of the Manual or to
alter or tamper with such Manual in any manner whatsoever which will
cause the resolutions and regulations of the Authority to be misrepresented
thereby.
A.
Each section
of the Manual and every part of each section is an independent section
or part of a section, and the holding of any section or a part thereof
to be unconstitutional, void or ineffective for any cause shall not
be deemed to affect the validity or constitutionality of any other
sections or parts thereof.
B.
Each section
of this resolution is an independent section, and the holding of any
section or part thereof to be unconstitutional, void or ineffective
for any cause shall not be deemed to affect the validity or constitutionality
of any other sections or parts thereof.
All resolutions or regulations or parts of resolutions or regulations
inconsistent with the provisions contained in the Manual adopted by
this resolution are hereby repealed; provided, however, that such
repeal shall only be to the extent of such inconsistency, and any
valid resolutions or regulations of the Authority which are not in
conflict with the provisions of the Manual shall be deemed to remain
in full force and effect.
A.
In compiling
and preparing the resolutions and regulations for adoption and revision
as part of the Manual, certain grammatical changes and other minor
changes were made in one or more of said resolutions and regulations.
It is the intention of the Authority that all such changes be adopted
as part of the Manual as if the resolutions or regulations so changed
had been previously formally amended to read as such.
