Under the authority of the Cannabis Control Board (CCB), the Town of Binghamton hereby creates this article to manage the operation of any cannabis distribution sites and to manage the operation of any cannabis consumption sites.
Cannabis distribution sites shall abide by the following restrictions:
A. 
Hours of operation will be no greater than 9:00 a.m. to 12:00 midnight, Sunday through Saturday.
B. 
The site must be at least 100 yards from any school, historical site, medical facility and any house of worship.
C. 
Before installing any temporary or permanent signs, the facility operator/owner must contact the Code Enforcement Department to obtain approval.
D. 
The facility must be located in an existing area zoned Commercial.
E. 
Appropriate site plan approval and permits must be obtained prior to commencement of operations.
F. 
The required number of parking spaces is one for every 100 square feet of retail facility space.
Cannabis consumption sites shall abide by the following restrictions:
A. 
Hours of Operation will be no greater than 9:00 a.m. to 12:00 midnight, Sunday through Saturday.
B. 
The site must be at least 500 yards from any school, historical site, medical facility and any house of worship.
C. 
Product odor must be undetectable within 200 yards in any direction of the facility.
D. 
Noise levels at the boundary of the facility's parcel must not exceed the permitted volume allowed by the Town Code.
E. 
Before installing any temporary or permanent signs, the facility operator/owner must contact the Code Enforcement Department to obtain approval.
F. 
The facility must be located in an existing area zoned Commercial.
G. 
Appropriate site plan approval and permits must be obtained.
H. 
The required number of parking spaces is one for every 100 square feet of retail space.
This article shall take effect immediately upon filing in the office of the Secretary of State in accordance with § 27 of the Municipal Home Rule Law.
