The City of Peekskill finds it is necessary to regulate the use of bicycles
and in-line skates in and around the streets and sidewalks of the City of
Peekskill to protect the health and safety of the operators of such devices
as well as the general public. This chapter shall apply whenever a bicycle
is or in-line skates are operated upon any highway; upon private roads open
to public motor vehicle traffic; upon any path set aside for the exclusive
use of bicycles or in-line skates, or both, and upon any public sidewalk located
along the following streets: North Division Street from Orchard Street to
Park Street; South Division Street from Park Street to First Street; South
Street from Smith Street to Division Street; Central Avenue from Union Avenue
to Division Street; Park Street from Division Street to James Street; full
length of Bank Street; Main Street from Route 9 to Broad Street; James Street
from Brown Street to Howard Street; Brown Street from South Division Street
to Broad Street; Esther Street - full length; Nelson Avenue from Paulding
Street to Central Avenue; Union Avenue from Central Avenue to Second Street;
First Street from South Division Street to Union Avenue, for the distance
such streets are located within the City of Peekskill's downtown area as defined
by the boundaries of the Downtown Business Improvement District ("the BID").
As used in this chapter, the following terms shall have the meaning
indicated:
Every two- or three-wheeled device upon which a person or persons
may ride, propelled by human power through a belt, a chain or gears, with
such wheels in a tandem or tricycle, except that it shall not include such
a device having solid tires and intended for use only on a sidewalk by preteenage
children.
A manufactured or assembled device consisting of an upper portion
that is intended to be secured to a human foot, with a frame or chassis attached
along the length of the bottom of such upper portion, with such frame or chassis
holding two or more wheels that are longitudinally aligned and used to skate
or glide, by means of human foot and leg power, while having such device attached
to each such foot or leg.
Every natural person, firm, copartnership, association or corporation.
A.
Obedience to regulations. Every person propelling or
riding a bicycle or skating or gliding on in-line skates in the City of Peekskill
shall be subject to the provisions of all ordinances and local laws of the
City of Peekskill and Article 34 of the Vehicle and Traffic Law of the State
of New York.
B.
Sidewalk riding. No bicycle or in-line skates shall be operated upon any public sidewalk located along those streets described in § 182-1 for the distance such streets are located within the boundaries of the BID. This section is not applicable to children 10 years of age or under nor to invalids or handicapped persons. All other persons may walk bicycles on sidewalks located within the BID.
C.
Riding on public highways, shoulders, bicycle or in-line
skate lanes and bicycle or in-line skate paths.
(1)
Upon all public highways, any bicycle or in-line skate
shall be driven either on a usable bicycle or in-line skate lane or, if a
usable bicycle or in-line skate lane has not been provided, as near the right-hand
curb or edge of the public highway as possible or upon a usable right-hand
shoulder in such a manner as to prevent undue interference with the flow of
traffic except when preparing for a left turn or when reasonably necessary
to avoid conditions that would make it unsafe to continue along near the right-hand
curb or edge.
(2)
Persons riding bicycles or skating or gliding on in-line
skates upon a public highway shall not ride more than two abreast. Persons
riding bicycles or skating or gliding on in-line skates upon a shoulder, bicycle
or in-line skate lane or bicycle or in-line skate path intended for the use
of bicycles or in-line skates may ride two or more abreast if sufficient space
is available, except that when passing a vehicle, bicycle or person on in-line
skates or pedestrian standing or proceeding along such shoulder, lane or path,
persons riding bicycles or skating or gliding on in-line skates shall ride,
skate or glide single file. Persons riding bicycles or skating or gliding
on in-line skates upon the public highway shall ride, skate or glide single
file when being overtaken by a vehicle.
(3)
Any person operating a bicycle or skating or gliding
on in-line skates who is entering the public highway from a private road,
driveway, alley or over a curb shall come to a full stop before
entering such highway.
D.
Clinging to vehicles. No person riding upon any bicycle,
or in-line skates shall attach the same or himself to any vehicle being operated.
Additionally, no person shall ride on or attach himself to the outside of
any vehicle being operated.
E.
Riding on bicycles.
(1)
A person propelling a bicycle shall not ride other than
upon or astride a permanent and regular seat attached thereto nor shall he
ride with his feet removed from the pedals nor remove both hands from the
handlebars.
(2)
No bicycle shall be used to carry another person unless
the bicycle is equipped with a seat securely fastened to the bicycle in the
rear of the driver and provided with foot rests or pedals and handgrips.
(3)
A person propelling a bicycle shall not tow or draw any
coaster, sled or person on in-line skates, toy vehicles or similar devices.
Every person convicted of a violation of any provisions of this chapter
may be punished by a fine of not more than $150 and/or by impounding the bicycle
or in-line skates for a period not to exceed 90 days.
