It shall be unlawful for any person or persons to burn trash, lumber, leaves, straw or other combustible material within the village limits of the Village of Albion, except for training exercises conducted by the Fire Department with proper Department of Environmental Conservation permits. This section shall not prohibit the use of recreational fires, provided that they do not create a nuisance, and in the event of a legitimate complaint, the Albion Police, Albion Fire Department or the Fire Marshal shall cause the fire to be extinguished.
The Fire Department shall notify the Fire Marshal of the date and time of any controlled burn pursuant to Part 1191.2(c) of the New York State Uniform Fire Prevention and Building Code. A demoolition permit shall be obtained from the Bureau of Code Enforcement and Fire Prevention prior to the use of a structure or building for such training exercise.
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment.
