A. 
No development activities shall commence nor shall any building or structure be erected, moved, added to or structurally altered or changed in use nor shall any land area or part thereof be changed in use without a zoning permit therefor issued by the Code Enforcement Official. No zoning permit shall be issued by the Code Enforcement Official except in conformity with the provisions of this chapter, unless he receives a written order from the Zoning Board of Appeals in the form of an administrative interpretation or variance as provided by this chapter.
B. 
The zoning permit may be issued in conjunction with and on the same form as a building permit.
C. 
The certificates and permits enumerated herein are hereby established for the equitable enforcement and administration of the provisions of this chapter. A zoning permit or special use permit shall be a prerequisite for an application for a building permit for the erection or alteration of a building, structure or use thereof or for the change in the use of any land area or existing building.
A. 
The Code Enforcement Official is hereby empowered under the procedures and requirements specified herein to issue a zoning permit for any plans regarding the construction or alteration or demolition of any building or part of any building or the change in the use of any land area or part thereof or for the change in use of any existing building, where he shall determine that such plans are not in violation of the provisions of this chapter.
B. 
If the proposed use is for the construction of a new single- or two-family dwelling, the expansion or structural alteration of an existing single- or two-family dwelling or the erection of a use or structure accessory to a single- or two-family dwelling, the Code Enforcement Official shall carefully consider the application for compliance with this chapter and may either issue or deny the permit applied for within 30 days after receipt of a complete application and determination of environmental significance. In the event of disapproval, the reasons shall be stated clearly in writing. The Code Enforcement Official shall deny a zoning permit until such conditions as the disapproval are based upon have been corrected.
C. 
If the application is for any permitted use other than those specified in Subsection B, the Code Enforcement Official shall, prior to the issuance of any permit, refer a copy of the zoning permit application, environmental assessment and site development plan to the Planning Board for approval in accordance with the procedures specified in Article X.
Under the terms of this chapter, the following types of zoning permits may be issued:
A. 
Permitted use. A zoning permit for a permitted use may be issued by the Code Enforcement Official on his own authority.
B. 
Site plan approval. A zoning permit for a permitted use, other than a one- or two-family dwelling, may be issued by the Code Enforcement Official after site plan approval from the Planning Board, pursuant to the procedures and standards contained in Article X of this chapter.
C. 
Special permit uses. A zoning permit for a special permit use may be issued by the Code Enforcement Official after site plan and special permit approval from the Planning Board, pursuant to the procedures and standards specified in Articles VII, IX and X of this chapter.
D. 
Zoning permit after an appeal or request for variance. A zoning permit may be issued by the Code Enforcement Official upon order of the Zoning Board of Appeals after a public hearing, as more fully described in Article VIII.
A. 
Application. Application shall be made with the Code Enforcement Official on forms approved by the Village Board and made available at the office of the Village Clerk or Code Enforcement Official.
B. 
Information. All information on the application form shall be completed. In addition, two copies of a property map shall be submitted with all applications. The map shall be either:
(1) 
Sketch map. A sketch map shall be required with all applications for one- or two-family dwellings and their customary accessory uses. The sketch map shall be drawn to scale and shall show the dimensions and location of the lot and the exact size and location of all existing and proposed buildings on the lot, parking areas, driveways, natural watercourses, surface drainage patterns and location of existing or proposed easements; or
(2) 
Site plan. A site plan shall be required with applications for all other uses. The requirements and procedures for site plan approval are in Article X.
C. 
Evidence of property ownership or intent to purchase. Copies of deeds, titles, purchase agreements or other proof of ownership or intent to purchase shall be attached to an application before it shall be accepted. Surveys should be submitted, if available. If issue of ownership of land or boundary exists, the Code Enforcement Official may require a survey by a licensed surveyor as part of the application.
D. 
Licenses. Any use currently licensed by federal, state, county or Village agencies and already operating within the Village shall present evidence of all currently valid licenses before any permits for expansion of such uses are considered.
E. 
Fee. The appropriate nonrefundable fee established by the Village Board shall be collected at the time of application. The fee structure shall be filed and posted at the office of the Village Clerk.
If all requirements of this chapter have been met, the Code Enforcement Official shall issue a zoning permit and return one approved copy of the map no later than 15 days after approval. The Code Enforcement Official shall file one copy of the approved permit in the official files of the Code Enforcement Official.
A. 
Any zoning permit or special use permit for which construction has not completed or use initiated within one year after issuance shall be automatically revoked, unless an extension is granted by the Code Enforcement Official.
B. 
The Code Enforcement Official may grant an extension for the time of completion and may include any conditions or requirements deemed necessary or desirable. Applicants shall justify the need for the proposed extension. Unless such an extension is requested and approved, further work as described in the canceled permit shall not proceed until a new permit has been obtained.
The applicant shall notify the Code Enforcement Official when the structure or use is ready for final inspection. The Code Enforcement Official shall then make a final inspection. If satisfied that the regulations pertaining to the project have been complied with and that the project has been completed as specified on the approved application, the Code Enforcement Official shall issue a certificate of compliance with this Zoning Chapter, granting permission to occupy or use the structure. The certificate of compliance may be issued in conjunction with and on the same form as any certificate of occupancy granted pursuant to the NYS Uniform Fire Prevention and Building Code.
