A. 
Creation of office of Code Enforcement Officer. There is hereby created by the Town Council of the Borough of Economy the position of Code Enforcement Officer which shall be under the direction and control of Borough Council and shall have the responsibility for administering and enforcing the provisions of this chapter and the following specified ordinances and no others:

B. 
Term, compensation and number of Code Enforcement Officers. The term, compensation and number of the Code Enforcement Officers shall be solely determined by the Town Council of the Borough of Economy, by resolution, as it shall from time to time deem appropriate.[6]

A. 
Enforcement powers of Code Enforcement Officer. The Code Enforcement Officer shall enforce and administer all of the provisions of this chapter and those ordinances as specified in § 9-1A hereof.
B. 
Duties of Code Enforcement Officer. The duties of the Code Enforcement Officer shall include the receipt of applications, the issuance of permits, the submission of written monthly reports to the Town Council, performing inspections to determine compliance with applicable codes and ordinances, the undertaking of systematic inspection programs, the undertaking of research and investigations, the recommendation of appropriate administrative rules, the collection of all permit fees and the payment of same to the Borough Secretary with an itemization of same as well as such other activities as may be required by the Town Council.
C. 
Chief Code Enforcement Officer. The Town Council of the Borough of Economy may appoint a Chief Code Enforcement Officer when it deems necessary and/or appropriate. In addition to the duties as outlined in this chapter, the Chief Code Enforcement Officer shall:

(1) 
Be consulted with by other Code Enforcement Officers before taking action on legal issues.
(2) 
Be assigned complicated cases involving legal action.
(3) 
Distribute workload equally between all Code Enforcement Officers when required due to volume of work available.
A. 
Permit required. An application for a permit shall be required in accordance with the provisions of those ordinances and codes which said Code Enforcement Officer has the responsibility to administer. Said application shall be submitted in such form as may be prescribed by the applicable ordinance or code under which it is submitted and shall be accompanied by any required fee.
B. 
Action on application. The Code Enforcement Officer shall examine said application to determine compliance with the applicable ordinance or code and shall either approve or reject said application within the time limits prescribed by the particular ordinance or code under which the application is submitted. If said application is rejected, the Code Enforcement Officer shall inform the applicant in writing of the reasons for such rejection.
C. 
Fees. Applicants for permits required by any of the ordinances and codes administered and enforced by the Code Enforcement Officer shall pay at the time of the application to the Code Enforcement Officer the permit fees established by the particular ordinance or code under which the application is being submitted.
D. 
All permits granted by the Code Enforcement Officer shall be valid for that amount of time as specified in the applicable ordinance or code under which the permit has been granted.
A. 
Procedure in case of violations. Whenever the Code Enforcement Officer determines that there are reasonable grounds to believe that there has been a violation of any provision of this chapter, or of the other applicable ordinances or codes, or of any rules and regulations adopted pursuant thereto, he shall forthwith initiate the procedure specified in the applicable ordinance or code under which the violation is alleged to have occurred.
B. 
Penalties. Any person who fails to correct a violation or institute a remedial action as ordered by the Code Enforcement Officer or who violates a provision or fails to comply with any requirements of the applicable ordinance shall be subject to the penalties as contained in that ordinance.
Any person requesting a variance or aggrieved by a decision of the Code Enforcement Officer may utilize the appeal procedure set forth in the applicable ordinance or code under which a decision has been rendered by the Code Enforcement Officer.
It is the purpose and intent of this chapter to vest in the Code Enforcement Officer the power and duty to administer the ordinances as specified herein and each of the following ordinances are hereby partially amended so that any and all references which relate to the individual responsible for administration and enforcement shall now hereafter refer to the Code Enforcement Officer as the individual responsible for administration and enforcement:
