[Adopted 10-14-1986 (Ch. 10, Art. VI, of the 1985 Code of Ordinances)]
For the purpose of this Part 4, the following words or phrases shall have the meanings ascribed thereto:
ALTERATION
The changing of a building, or part of one, by changing the interior floor plan through adding, replacing, removing or moving walls, ceilings, and/or installed mechanical equipment.
BUILDING
Any structure with sides and a roof, constructed of any materials and used for any purpose.
BUSINESS
Any building or portion thereof where work is carried on such as a factory, store, or office, by any person, partnership, corporation, association, or concern engaged in commerce, manufacturing, sales, or a service.
COMMERCIAL BUILDING
Any building used in the conduct of sales or the display of merchandise for sale; and any building used for the conduct of any business activity not industrial in nature, including professional services.
CONTRACTED PRICE
The amount of money agreed upon, by written contract between two parties, for the accomplishment of work for which a permit is applied for.
ESTIMATED COST
The reasonable value (as determined by the Building Official) of all services, labor, materials and use of appliances and devices in the accomplishment of work for which a permit is applied for; does not include excavation, grading, landscaping, painting, decorating or other such embellishments, but does include any other aspect necessary for the safe and lawful use of the building.
EXTENSION
The extending of a building by adding thereto an attached exterior portion, thereby making the building larger in any way.
FIRE PREVENTION OFFICER
The Chief of the Fire Department and those Fire Department officials so designated by the Chief of the Department and charged with the responsibility and authority to enforce all state and Town fire codes as well as the provisions of this Part 4.
INDUSTRIAL BUILDING
Any building used in the conduct of industrial activity, including but not limited to fabrication, assembly, product development and similar activity commonly considered industrial; and buildings or portions thereof used by such industry.
LICENSE
Any license required by any Town ordinance or state statute wherein the Fire Department is required to make a firesafety inspection.
MECHANICAL EQUIPMENT
Includes, but not limited to, boilers, furnaces, oil burners, gas burners, electrical heat, air conditioners, dust conveyer systems, ventilating systems, elevators, dumbwaiters, lifts, conveyers, refrigeration systems, fire alarms, fixed fire suppression, firesafety equipment, ovens, generators and the like.
MULTIRESIDENTIAL BUILDING
Any building of four or more family units or apartments arranged such that there is no common means of egress shared by any two family units or apartments.
REPAIR
The modification of a building or portion thereof, or of equipment of any kind, to restore, to useful or attractive condition; repair does not include addition to, expansion of, or replacement of the basic elements of the structure or equipment.
SINGLE RESIDENTIAL BUILDING
Any one-, two- or three-family residential building.
TANK
Any container with a liquid (water) capacity of greater than 60 US gallons constructed of any material to be used for the storage of any combustible or flammable liquid (as defined in NFPA Standard 30 1973), or combustible or flammable gas, or any material as listed on the Rhode Island Designated Substance List (pursuant to the General Laws of Rhode Island, Chapter 28-21).
A. 
Any person, including any partnership, corporation or association, undertaking the erection, extension, alteration or repair, or moving of a structure; or undertaking any structural alteration, electrical wiring, or installation of plumbing or mechanical equipment in an existing structure; or undertaking any changes that may affect the firesafety of a building or any portion thereof; shall first make application for an inspection and for a plan review in the Smithfield Fire Prevention Office. Said application shall be made at least 21 calendar days prior to the start of any construction, or work, accompanied by the proper fee or fees as described in §§ 198-150 and 198-151 of this Part 4. No construction or work shall be started until the required application has been approved by the Fire Prevention Office.
B. 
In addition to the general provisions above, this Part 4 also includes special categories for which inspections and/or plan review fees are required. No construction or work shall be started until the required application has been approved by the fire prevention office.
C. 
In all matters relating to the execution of this Part 4, the Fire Prevention Officer's interpretations and decisions shall be binding, appealable to the Chief of the Department. If the applicant is not in agreement with the decision of the Fire Chief, the applicant may appeal within 10 calendar days to the Town Council. The Town Council's decision shall be binding and final.
D. 
Any and all construction or work to be permitted shall be in complete compliance with the Rhode Island Fire Safety Code 1976 as amended and with the Smithfield Fire Prevention Code.
E. 
All fees as determined by this Part 4, where based on construction costs, shall be based on full valuation of current construction costs. Construction costs (per square foot) shall be determined by the Smithfield Building Official.
F. 
Fee rates shall be reviewed annually by the Fire Prevention Officer and the Chief of the Department to determine if new and/or amended fee rates are appropriate. If so, they shall be submitted to the Town Council for consideration.
G. 
There shall be no remuneration to any person for any inspection and/or plan review as required by this Part 4.
H. 
All fees shall be made payable to the Town of Smithfield. Payment shall be made to the Smithfield Fire Prevention Office which shall make a record of such payment and then remit the same to the Town treasurer.
I. 
No fees shall be paid for any building owned by the Town of Smithfield, State of Rhode Island or the United States Government.
J. 
No fees shall be paid for a firesafety inspection as required for a license renewal.

A. 
The following fee schedule shall be in addition to the fee computed as the basis of the "Schedule of Fee Rates" set out in § 198-150.
(1) 
For any new automatic sprinkler system or any change to an existing automatic sprinkler system there shall be a fee of $30 plus a fee of $0.50 for each sprinkler head installed.
(2) 
For any new automatic fire alarm system or any change to an existing fire alarm system there shall be a fee of $10 plus a fee of $0.50 for each fire alarm device installed.
(3) 
For any new fixed fire suppression system or any change to an existing system there shall be a fee of $30 per system.
(4) 
There shall be a fee of $30 for a firesafety inspection for any new license.
(5) 
There shall be a fee of $30 for a firesafety inspection for any license transfer.
B. 
The fee computed in accordance with the "Schedule of Fee Rates" shall not be added to the following:
(1) 
For any site plan review there shall be a fee of $20 plus a fee of $2 per acre.
(2) 
There shall be a fee of $50 per tank for any tank installation as covered under the provisions of this Part 4.
(3) 
There shall be a fee of $20 per tank for the removal or abandonment of any tank as covered under the provisions of this Part 4.
(4) 
There shall be a fee of $20 for the plan review of each new single residential building when conducted by the Fire Department.
(5) 
There shall be a fee of $5 for each family unit or apartment for all new multiresidential buildings.
(6) 
There shall be a fee of $30 for the inspection of any tent exceeding 120 square feet erected, maintained, operated or used in the Town.
(7) 
There shall be no fee charged for a smoke detector system inspection pursuant to the requirements of Rhode Island Fire Safety Code, Chapter 23-28.35.
