As used in this article, the following terms shall have the meanings indicated:
TEMPORARY SIGN
Any sign erected or displayed for less than 30 days.
A. 
No signs other than signs placed by agencies or the government shall be erected on any public property, except as follows:

(1) 
Nonprofit organizations shall be permitted to seek advertisements to be posted on municipal properties during events that are held by the nonprofit group on municipal property.
(a) 
Signs posted as a result of the solicitation shall be placed on the property no more than 24 hours prior to the scheduled event and shall be removed from the area within 24 hours after the event has occurred. This provision is required even for repetitive events.
(b) 
No advertisements shall be permitted for alcohol, tobacco or other suggestive or obscene advertisements.
(2) 
An application shall be made to the City for the posting of the signs, including the date of the event and the advertisers to be posted, as well as the parties responsible for the posting and removal of the signs.
B. 
No temporary sign shall be placed on any private property without the prior consent of the owner thereof.
C. 
No temporary sign shall be placed on any utility pole, street lamp or fire alarm box except for utility identification or similar purposes.
D. 
No sign or other advertising structure shall be erected or displayed at the intersection of any street in such a manner as to obstruct vision.
A. 
Violation of the provisions of this article or failure to comply with any of its requirements shall constitute a misdemeanor. Any person who violates this article or fails to comply with any of its requirements shall upon conviction thereof be fined not less than $25 nor more than $1,000. Each day such violation continues shall be considered a separate offense.
B. 
Nothing contained herein shall prevent the City of Passaic from taking such other lawful action as necessary to prevent or remedy any violation.
