Whenever in any place or on any premises within the Village of Floral Park, matter from any cesspool or septic tank shall back up, run or overflow thereon, it shall be the duty of the owner, lessee or occupant of any premises where such condition exists to immediately have such cesspool or septic tank and premises cleaned in a manner so as to remove or abate such condition.
Upon order being made by the County Health Officer or the General Foreman directing the owner, lessee or occupant of such building to remove or abate such condition and upon failure of such owner, lessee or occupant to do so within 24 hours after such notice is made, the Board of Trustees may cause the same to be done and access the cost thereof upon the land whereon such condition is found.
It shall be unlawful for any person, firm or corporation hereafter to clean or empty any cesspool or septic tank without first having obtained a permit therefor from the Village Clerk. The work of cleaning and emptying the cesspool or septic tank in the commercial zone shall be done between the hours of 10:00 P.M., and 7:00 A.M., unless in case of emergency special permission is obtained from the Village Clerk. An application for a permit shall be in writing, and filed with the Village Clerk accompanied by the written consent of the owner of the property upon which the cesspool or septic tank shall be located. A fee of $1 for each permit shall be paid by the applicant at the time of filing such application.

Any person violating any provision of this article shall be liable for and forfeit and pay a penalty as provided in § 32-13 of Chapter 32 hereof. Said violation shall constitute and is hereby declared to be disorderly conduct, and any person violating this article or any provisions thereof shall be and hereby is declared a disorderly person as provided in § 32-1 of Chapter 32 hereof.
It shall be unlawful for any person, firm or corporation to hereafter construct any type of cesspool or septic tank without first obtaining a permit from the Village Clerk of the Village of Floral Park approved by the General Foreman.
Cesspools hereafter constructed shall be of masonry eight inches thick or standard four-inch interlocking cement cesspool blocks as approved by the General Foreman. Cesspools shall not be less than eight feet in diameter and not less than five feet deep below the invert of the house sewer or equivalent dimensions.
When cesspools are constructed of cement blocks of any type, the domes of same shall be plastered with at least one inch of cement plaster consisting of two parts sand and one part cement.
All cesspools shall be provided with a solid removable cover which shall be at least one foot below grade, and said cesspools shall be maintained in a sanitary condition at all times.
A cesspool shall not be constructed nearer than 15 feet to a building foundation unless permission shall be obtained from the General Foreman.
Before a permit is issued, the applicant shall pay to the Village Clerk the sum of $2 for the permit plus a deposit of $5 to insure proper completion of work. This deposit shall be returned upon issuance by the General Foreman of a certificate of compliance. In the event said certificate is not obtained within 12 months after completion of work, said deposit shall be forfeited.
Upon completion of the construction of the cesspool, and before any backfilling is done, an application for inspection shall be made to the General Foreman. If he finds that the cesspool is built in accordance to this ordinance, he shall issue to the applicant a certificate of compliance.
There shall be no charge for a permit and no deposit required for cesspools built as an accessory to new building construction. Such cesspools, however, must be built in compliance with this ordinance.
