No person shall place or leave or cause to be placed or left or allow to be left upon any street or sidewalk in the Village any goods, wares, merchandise, boxes, showstands, papers, dirt sweepings or litter of any kind or character whatsoever, and no person being the abutting owner, lessee or occupant of property abutting upon such sidewalk shall permit such obstructions or litter to be placed or remain upon any sidewalk, nor shall any person or owner or occupant of abutting property as aforesaid throw or permit to be thrown any ashes, cigarette or cigar butts, paper, litter or other rubbish or material whatsoever in any street, highway or alley in the Village nor permit nor suffer to remain any obstruction or litter on any sidewalk, street, highway or alley in the Village. The penalty for a violation of this section shall be as specified in § 32-14 of this Code.

No person or persons shall plant nor shall any abutting owner, occupant or lessee plant or permit the planting of any trees immediately adjacent to any sidewalk in the Village or between the sidewalk and the curb upon any street in the Village, unless a permit therefor shall first be obtained. Application for a permit to plant trees shall be made to the Village Clerk, in writing, in such form as the Board of Trustees may provide. Such application shall specify the location and kind of trees to be planted. Such application shall be referred to the Superintendent of Parks for approval, and no permit shall be granted for the planting of any trees except those known as oak, elm or Norway maple. Any trees or shrubs planted in violation of this provision may be removed by the Village and the cost thereof certified to the Village Clerk and assessed against the abutting property as a tax, and no trees or shrubs shall be planted within a setback line now established or hereafter established by ordinance.

Except as herein provided, no excavation may be made in any street or in or across or under any sidewalk in the Village, and no building materials or merchandise, boxes or debris of any kind or description may be stored or placed in any street or sidewalk in the Village.

No goods, wares or merchandise shall be displayed or offered for sale upon any sidewalk in the Village nor shall such sidewalk be otherwise encumbered.
No person shall hawk any merchandise from the premises adjacent to any sidewalk in the Village from any storefront, window or driveway, nor shall any stands, booths or racks for the sale of merchandise be placed adjacent to any sidewalk.

A. 
It shall be the duty of the Police Department to enforce the provisions of § 81-23. The Commissioner of Police is hereby authorized and directed to supply police officers, parking meter attendants and/or code enforcement personnel with summonses for the purpose of giving notice to persons violating any provision of § 81-23. Such notice may be given by delivering such summons to the violator or by mailing such summons to the violator's residence. Such summons shall direct the violator to appear, present such summons and answer to the charge against him at a designated place on a certain date and at a certain hour specified therein. The police officer, parking meter attendant or code enforcer shall deliver copies of such summons to the Village Justice.
B. 
Any person violating any of the provisions of this section shall be liable for and pay a penalty as provided in § 32-14 of Chapter 32 hereof, but, in no event less than $25. Said violation shall constitute and is hereby declared to be disorderly conduct. Any person violating this article or any provisions thereof shall be and hereby is declared a disorderly person as provided in § 32-1 of Chapter 32 hereof.
