If the application and plan conform to the requirements of this chapter, provide for the work to be performed in accordance with the current New Jersey State Highway specifications and are approved by the Township Engineer, the Township Clerk shall issue the permit upon receipt of a deposit covering engineering review and township administration determined as follows:

D. 
In lieu of a security deposit in accordance with the above schedule, the applicant may deposit the sum of $1,500 in cash with the Township Clerk.
A. 
After final and permanent repairs are completed, a fee covering inspection charges shall be charged against the deposit at the rate appearing in the Township Fee Schedule submitted annually by the Township Engineer to the Township Clerk for engineering services rendered to the township. If at the end of a six-month period from the issuance of the permit and completion of the permanent cover no defects in the contractor's work appear, the work will be considered accepted by the township and the balance of the township deposit not used to defray engineering inspection costs will be returned to the applicant.
B. 
If during such six-month period any settlement occurs in the excavation or opening, the Township Engineer or his designee shall notify the permittee by ordinary mail addressed to the location given on the application permit to correct the condition within 10 working days of the notice and complete a new temporary cover, after which final and permanent repairs shall again be made as hereinabove. The Township Clerk shall charge and deduct an additional fee covering additional inspection charges under this subsection based upon the Township Engineer's Fee Schedule filed with the Township Clerk. In the event that the permittee shall fail to correct the conditions as required herein, the township may do so, and all funds on deposit shall, without further notice, be credited to the general revenues of the township to defray the cost of the work required to be performed by the township.

A. 
When the applicant is a public utility as defined by the Statutes of the State of New Jersey, the township may accept, in lieu of required deposits and fees previously set forth herein, a guaranty bond to the township in the sum of $10,000 plus an application fee of $20 per work location and $50 per work location for the engineering review fee. For the purpose of this section, "work location" is defined as any opening or series of openings in the same street. Each eight-hundred-foot portion of the street shall constitute a separate work location.
B. 
In the case of exceptional or complicated openings, or where the proposed opening involves construction of a longitudinal pipe main serving more than one property, or in any case where the area to be opened exceeds 500 square feet, the Township Engineer may, at his discretion, require the applicant to deposit in cash a certain sum to be placed in escrow by the township to cover the cost of inspection by professionals employed by the township. The amount of the initial deposit shall be established by regulation in an amount reasonably calculated to equal the cost of the necessary inspections. Sums not utilized in the inspection process shall be returned to the applicant. If additional sums are deemed necessary, the applicant shall be notified of the required additional amount and shall add such sum to the escrow. The applicant must also execute an agreement to underwrite necessary engineering costs incurred by the township if the repair to the street is unsatisfactory and repair by the township is necessary.
