There shall be a Personnel Relations Review Board appointed by the Board of Selectmen and said Personnel Relations Review Board shall consist of three members who shall be appointed as follows: one for a term of one year who shall be a member of the Personnel Board; one for a term of two years who shall be a member of the executive branch of the Marblehead Municipal Employees Association; and one for a term of three years, who shall be Chairman, and shall not be an elected official, a member of any Town board, commission or advisory committee, employee of the Town, or any other person having charge of an expenditure of money on behalf of the Town. All subsequent appointments shall be made for a term of three years.
A. 
"Employee" means any employee of the Town other than those appointed by the School Committee.
B. 
"Grievance" means any dispute between an employee of the Town and his appointing authority arising out of an exercise of administrative discretion by such authority under the contract of employment between the employee and the Town, except a dispute concerning a change in one or more terms of such contract and except also a dispute which is, or upon proper appeal would be, within the jurisdiction of the Civil Service Commission or the Contributory Retirement Appeal Board.
The Personnel Relations Review Board is empowered to adjust the grievances of employees, provided that such adjustment shall not involve the Town in an expenditure of money in excess of the appropriation made for the use of said Board.
A. 
An employee alleging a grievance shall present said grievance to the department head, board or commission involved within 30 days of the time the grievant knew or should have reasonably known of the occurrence or lack of occurrence which gave rise to the grievance, and a decision thereon shall be rendered thereon within two working days.

B. 
If such grievance is not settled as provided in the aforesaid § 24-10A, said employee shall present said grievance, in writing, to the Personnel Relations Review Board, who shall hear the employee, department head, board or commission involved. Said Personnel Relations Review Board shall render its decision, in writing, within five working days from the date of said hearing and cause a copy of said decision to be delivered to said employee, department head, board or commission involved. The decision of said Personnel Relations Review Board shall be final, except as to employees of the Police Department, who may refer said decision to the Board of Selectmen within 15 days, and its decision shall be final.

C. 
An employee shall not have his position prejudiced by following the aforesaid procedure.
