A. 
The Wisconsin Motor Vehicle Code as amended from time to time is adopted and incorporated into Menominee law as a civil regulatory ordinance with certain exceptions noted below.
B. 
This article shall be enforced by any duly authorized Menominee tribal police officers and Menominee tribal conservation officers. Such officers are law enforcement officers for the authorizations pursuant to § 132-3, and that authority applies to the other designations of enforcement authority in the remaining articles of Chapter 550.

A. 
Second and succeeding offenses for operating while under the influence (OWI) shall be criminal offenses and shall be penalized at the discretion of the Tribal Court.
B. 
All OWI offenses and all reckless driving offenses are nonforfeiture actions and require court appearances.
C. 
Violation of §§ 346.67(1), 346.04(2t) and 346.62(3) and (4), Wis. Stats., shall be a criminal offense and the penalty shall be that prescribed in Ch. 346, Wis. Stats., except that in no circumstances shall the Court sentence any defendant to a fine exceeding $5,000 or jail the defendant for a term exceeding one year per violation.

D. 
Winter parking is a traditional governmental function and shall be a civil regulatory function of the Menominee Indian Tribe of Wisconsin under tribal law, Chapter 550, Article II.

Traveling on Dam No. 3 is a traditional governmental function and shall be a civil regulatory function of the Menominee Indian Tribe of Wisconsin under tribal law, Chapter 550, Article III.

Registration of all-terrain vehicles is a traditional governmental function and shall be a civil regulatory function of the Menominee Indian Tribe of Wisconsin under tribal law, Chapter 550, Article IV.

Seatbelt requirements are a traditional governmental function and shall be a civil regulatory function of the Menominee Indian Tribe of Wisconsin under tribal law, Chapter 550, Article V.
