As used in this chapter, the following terms
shall have the meanings indicated:
DRY FILL
Wood, stumps, masonry materials, rock, brick,
dirt, stone, bituminous materials, stone and similar materials.
GARBAGE
Putrescible animal and vegetable waste resulting from the
handling, preparation, cooking and consumption of food.
REFUSE
All putrescible and nonputrescible solid waste (excluding
body waste), including but not limited to garbage, rubbish, ashes,
street cleanings, dead animals, abandoned automobiles and solid market
and industrial wastes.
RUBBISH
Nonputrescible solid waste consisting of both combustible
and noncombustible wastes, such as paper, wrappings, cigarettes, cans,
bottles, yard clippings, leaves, wood, glass, bedding, crockery, building
materials and similar materials.
Any person, firm, corporation, unincorporated association or organization which violates §
78-2 of this chapter may be fined up to $1,000. Any person who violates §
78-2 of this chapter may, in addition to the fine authorized in the preceding sentence, be imprisoned for not more than 90 days for such offense. Such penalties shall also apply, in the discretion of the court, to a person or persons who had actual knowledge of the activities set forth in §
78-2 hereof, committed by a firm, corporation, unincorporated association or organization and who had managerial status within such firm, corporation, unincorporated association or organization sufficient to prevent such prohibited acts, but who did not act to prevent such acts.
