Any person, firm or corporation violating any of the provisions of this chapter shall be guilty of an offense punishable by a fine or imprisonment, or both; however, for the purpose of conferring jurisdiction upon courts and judicial officers, such violations shall be deemed misdemeanors, and for such purposes only, all provisions of law relating to misdemeanors shall apply to such violations. Notwithstanding the foregoing, any person, firm, association or corporation violating any provision of this chapter shall be subject to a penalty in a sum not exceeding $500 for the first violation and a sum not exceeding $1,000 for any subsequent violation, said penalties to be recoverable in a civil action, in the name of the Town of Smithtown, as damages.

A. 
Nothing contained herein shall relieve an applicant from the necessity of obtaining permits as may be required for public assemblies, use of parklands within the Town of Smithtown or other permits as may be required under the Code of the Town of Smithtown.
B. 
Any application for a special event, parade or outdoor assemblage that includes a proposed display of pyrotechnics, commonly referred to as fireworks, shall clearly indicate said proposal on the application form to conduct a special event, parade or outdoor assemblage and shall comply fully with the provisions of Article XXI, Fireworks, of the Fire Prevention Code of the Town of Smithtown[1] and the applicable current standards of the National Fire Protection Association.

C. 
Nothing contained herein shall relieve an applicant from the necessity of obtaining permits as may be required for special events or parades from any other New York State, Suffolk County, or other agency as may be required by law.

In the event that the person, firm, corporation or other entity conducting a special event, parade or outdoor assemblage violates or causes to be violated any condition set forth in a permit issued pursuant to this chapter, the Town Board may revoke such permit authorizing the conduct of the special event, parade or outdoor assemblage.
