That a certain document, three copies of which are on file in
the office of the Borough of Greenville, being marked and designated
as the International Fire Code, 2009 edition, including Appendix Chapters
A through and including J, as published by the International Code
Council, be and is hereby adopted as the Fire Code of the Borough
of Greenville, in the State of Pennsylvania regulating and governing
the safeguarding of life and property from fire and explosion hazards
arising from the storage, handling and use of hazardous substances,
materials and devices, and from conditions hazardous to life or property
in the occupancy of buildings and premises as herein provided; providing
for the issuance of permits and collection of fees therefore; and
each and all of the regulations, provisions, penalties, conditions
and terms of said Fire Code on file in the office of the Borough of
Greenville are hereby referred to, adopted, and made a part hereof,
as if fully set out in this article.
This article shall be
construed to secure its expressed intent, which is to ensure public
health, safety and welfare insofar as they are affected by the continued
occupancy and maintenance of structures and premises. Existing structures
and premises that do not comply with these provisions shall be altered
or repaired to provide a minimum level of health and safety as required
herein.
Where there is a conflict between a general requirement and
a specific requirement, the specific requirement shall govern. Where
differences occur between provisions of this article and the referenced
standards, the provisions of this article shall apply. Where, in a
specific case, different sections of this article specify different
requirements, the most restrictive shall govern.
Repairs, additions or alterations to a structure, or changes
of occupancy, shall be done in accordance with the procedures and
provisions of the Uniform Construction Code of Pennsylvania, International
Building Code, International Plumbing Code, International Property
Maintenance Code, NFPA 101 Life Safety Code, and NFPA 70 National
Electrical Code.
The provisions of this article shall not affect any act done,
or liability incurred, nor shall they affect any suit or prosecution
pending or to be instituted to enforce any right or penalty or to
punish any offense under the authority of any of the ordinances in
place prior to the adoption of this article.
The fee schedule for negligent or accidental or unnecessary
fire alarm activation is provided by resolution by Borough Council
and as amended from time to time.
Any person who shall violate a provision of this article, or
fail to comply therewith, or with any of the requirements thereof,
and any person aiding, abetting, or assisting in any such violation,
shall be guilty of a summary offense, punishable by a fine of not
less than $250 and not more than $1,000 or by imprisonment not exceeding
90 days, or both such fine and imprisonment, together with the prosecution
for each offense. Each day that a violation continues shall constitute
a fine of not less than $25 and not more than $100. All fines and
penalties received by the Borough for enforcement of this article
shall be paid to the Treasurer of the Borough of Greenville.
