This chapter shall be known and may be cited as the "Greenville Borough Property Maintenance Code."
A certain document, copies of which are on file in the office of the Borough Secretary of the Borough of Greenville, Mercer County, Pennsylvania, being marked and designated as the "International Code Council, Inc., International Property Maintenance Code, 2009 Edition," as amended and updated from time to time (to include any annual, biennial and triennial edition), creating a code of property maintenance regulations for the protection of public health, safety and welfare as herein provided. Each and all of the regulations of the International Property Maintenance Code of 2009, except as provided herein in § 384-3 of this chapter, are hereby referred to, adopted and made a part hereof as if fully set out in this chapter; and in addition to insertions in subsequent sections.
Changes from the International Property Maintenance Code (2009), to the Property Maintenance Code of Greenville Borough, Mercer County, Pennsylvania are as follows:
A. 
Section 101. General.
§ 101.1 SHORT TITLE shall be amended by inserting "Greenville Borough, Mercer County, Pennsylvania."
B. 
Section 103. Department of Property Maintenance inspection.
§ 103.5 FEES shall provide as follows:
The fees for activities and services performed by Greenville's designated code officials, in carrying out responsibilities under this code shall be established, from time to time, by resolution of Greenville Borough Council.
C. 
Section 106. Violations.
§ 106.4. PENALTY is amended to read:
Any person who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, and any person aiding, abetting, or assisting in any such violation, shall be guilty of a summary offense, punishable by a fine of not less than $50 and not more than $1,000 or by imprisonment not exceeding 90 days, or both such fine and imprisonment, together with the prosecution for each offense. Each day that a violation continues shall constitute a fine of not less than $5 and not more than $10. All fines and penalties received by the Borough for enforcement of this code shall be paid to the Treasurer of the Borough of Greenville.
§ 106.4.1 REPEAT OFFENDER VIOLATIONS AND PENALTIES; NOTICE OF VIOLATION AND APPEAL PROCEDURES is added to read:
A.
The Code Enforcement Officer shall only be required to provide one notice per property for each type of violation during a three-hundred-sixty-five-day period. Failure to comply with the written notice from the Code Enforcement Officer in a timely manner on any subsequent violations, of the same type, occurring within a three-hundred-sixty-five-day period shall be actionable.
B.
In the event that the violation is abated after notice and there is more than one violation of the same type in any three-hundred-sixty-five-day period, the Code Enforcement Officer shall issue a non-traffic citation with a fine in the amount of $25 for the first offense, $100 for the second offense, and $200 for the third and every subsequent offense thereafter. The fine shall be paid to the Borough Treasurer within 48 hours. In the event that the fine is not paid within 48 hours, the citation will be turned over to the courts for collection.
C.
Appeal procedures for repeat violations: The property owner shall have the right to appeal to the District Court any non-traffic citation issued by the Codes Officer, wherein the non-traffic citation was issued for repeat violations.
D. 
Section 111. Means of appeal.
§ 111.2. MEMBERSHIP OF BOARD, first paragraph, is amended to read:
Membership of the Board shall be in accordance with § 215-5 of Chapter 215, "Code Enforcement" of the Code of Greenville Borough.
E. 
Section 112. Stop-work order.
§ 112.4 FAILURE TO COMPLY
Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $300 or more than $1,000.
F. 
Section 302. Exterior property areas.
§ 302.1.1. UNHEALTHY ACCUMULATIONS
It shall be unlawful within the Borough of Greenville to scrap, dismantle, or tear apart, to accumulate rubbish, save, collect, stockpile, or keep any abandoned, discarded junk, dilapidated vehicle, boat, trailer, or recreational vehicle of any type.
§ 302.3. SIDEWALKS AND DRIVEWAYS, shall be amended by inserting § 302.3.1. SNOW REMOVAL
All sidewalks and walk paths "even if there is no hard surface walkway" must be cleared to maintain a thirty-six-inch pathway within 24 hours after the snowfall; after which, a twenty-four-hour warning will be issued, and after 48 hours, a non-traffic citation will be issued as written in Section 106.4.1 and as amended herein.
§ 302.4. WEEDS, first sentence, is amended to read, in pertinent part:
All premises and exterior property shall be maintained free from weeds or plant growth in excess of six inches.
Second paragraph is amended to read:
Upon failure of the owner or agent having charge of a property to cut and destroy weeds after service of a notice of violation and within the time period as specified in the notice of violation, the Borough authorities may remove, trim or cut the grass, weeds or vegetation, and the cost of the work, together with an additional penalty of 10%, may be collected by the Borough from that person in the manner provided by law.
§ 302.8. MOTOR VEHICLES, first paragraph, sentence one is amended to read, in pertinent part:
Except as provided for in other regulations, no inoperative or unlicensed motor vehicle or recreational vehicle shall be parked, kept or stored on any premises more than 180 days, and no vehicle at anytime shall be in the a state of major disassembly, disrepair, or in the process of being stripped or dismantled.
G. 
Section 304. Exterior structure.
§ 304.14 INSECT SCREENS, first sentence, is amended to read, in pertinent part:
During the period from May 1 to November 1, every door, window and other outside opening required for ventilation of habitable rooms.
H. 
Section 602. Heating facilities.
§ 602.3. HEAT SUPPLY, first paragraph, is amended to read:
Every owner and operator of any building, who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guest room on terms, either expressed or implied, to furnish heat to the occupants thereof, shall supply heat during the period of October 1 to June 1, to maintain a temperature not less than 68° F. (20° C.) in all habitable rooms, bathrooms and toilet rooms.
§ 602.4 OCCUPIABLE WORK SPACES, first paragraph, is amended to read:
Indoor occupiable work spaces shall be supplied with heat during the period from October 1 to June 1 to maintain a temperature of not less than 65° F. (18° C.) during the time these spaces are occupied.
This chapter shall be construed to secure its expressed intent, which is to ensure public health, safety and welfare insofar as they are affected by the continued occupancy and maintenance of structures and premises. Existing structures and premises that do not comply with these provisions shall be altered or repaired to provide a minimum level of health and safety as required herein.
Where there is a conflict between a general requirement and a specific requirement, the specific requirement shall govern. Where differences occur between provisions of this chapter and the referenced standards, the provisions of this chapter shall apply. Where, in a specific case, different sections of this chapter specify different requirements, the most restrictive shall govern.
Repairs, additions or alterations to a structure, or changes of occupancy, shall be done in accordance with the procedures and provisions of the Uniform Construction Code of Pennsylvania, International Building Code, International Plumbing Code, International Fire Code, NFPA 101 Life Safety Code, and NFPA 70 National Electrical Code.
The provisions of this chapter shall not affect any act done, or liability incurred, nor shall they affect any suit or prosecution pending or to be instituted to enforce any right or penalty or to punish any offense under the authority of any of the ordinances in place prior to the adoption of this chapter.
