The following definitions shall be applicable to all provisions of this chapter:
GARAGE SALES
All sales entitled "garage sales," "lawn sale," "attic sale," "porch sale," "flea market" or any similar casual sale of tangible personal property which is advertised by any means whereby the public at large is or can be made aware of the sale or at which the public may purchase tangible personal property.
PERSONAL PROPERTY
All property purchased or acquired by the respective homeowners or occupants holding the sale for their own respective household use, excluding property purchased for resale or acquired by gift, consignment or otherwise for the purpose of resale.
No person shall within the limits of the Town of Belvidere:
A. 
Conduct more than one garage sale, as herein defined, within any one calendar year.
B. 
Conduct a garage sale, as herein defined, without first obtaining a license from the municipality as provided under § 287-3.
C. 
Cause to be sold or made available for sale at any garage sale, as herein defined, any property other than personal property, as herein defined.
D. 
Cause to be conducted or conduct a garage sale, as herein defined, prior to the hour of 9:00 a.m. or subsequent to the hour of 6:00 p.m. or on any Sunday.
A. 
A license shall be issued for each lot as shown on the Official Tax Map of the Town of Belvidere only once within a twelve-month period beginning January 1 of each and every year. No license shall be issued for more than two consecutive calendar days.
B. 
All licenses shall be issued free of charge from the Town Municipal Building upon the filing of the following information by the applicant:
(1) 
Name of person, firm, group, corporation, association or organization conducting the sale.
(2) 
Name of owner of the property on which the sale is to be conducted and consent of owner if applicant is other than owner.
(3) 
Location at which the sale is to be conducted.
(4) 
Number of days of the sale.
(5) 
Date and nature of any past sale.
(6) 
Relationship or connection applicant may have had with any other person conducting a sale and the date or dates of such sale.
(7) 
Whether or not applicant has been issued any other vendor's license by any local, state or federal agency.
(8) 
Sworn statement or affirmation by the person signing that the information therein given is full and true and known to him to be so true.
The provisions of this chapter shall not apply to or affect the following persons or sales:
A. 
Persons selling goods pursuant to an order or process of a court of competent jurisdiction.
B. 
Any person selling or advertising for sale an item or items of personal property which are specifically named or described in the advertisement and which separate items do not exceed five in number.
C. 
Any sale conducted by any merchant or other business establishment from or at a place of business wherein the sale would be permitted by the zoning regulations of the Town of Belvidere.[1]

D. 
Any bona fide charitable, eleemosynary, educational, cultural or governmental institution or organization.

Any person violating any provision of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $500 or by imprisonment for not more than 90 days, or both.
