The purpose of this chapter is to provide for the enforcement
of the following rules and regulations adopted by the Trustees of
the Free Public Library of the Town of Belvidere (hereinafter referred
to as the "library"), by establishing penalties and procedures for
the adjudication of any alleged violations of the rules and regulations
in the Municipal Court of the Town.
No person shall detain or fail to return any book, periodical,
pamphlet, artistic reproduction, phonograph recording, audiovisual
material or any other article borrowed on a card issued by the library
(hereinafter referred to as a "library card") contrary to the rules
and regulations of said library or a member library of the Interlibrary
Loan System or any similar system (hereinafter referred to as "member
library") after delinquency notices have been issued, and after 30
days have elapsed from the date of posting by certified mail, return
receipt requested or if the same is refused or unclaimed by regular
mail, of a final notice demanding return thereof, addressed to said
person at the last address furnished to the library. In the case of
a minor, the letter or complaint shall be directed to the parents
or guardians of the minor involved.
No person shall cut, tear, deface, disfigure, damage or otherwise
destroy any book, periodical, pamphlet, artistic reproduction, phonograph
recording, audiovisual material or any other article, or any part
thereof, which is owned by, in the custody of or is borrowed from
the library or a member library.
No person shall remove any book, periodical, pamphlet, artistic
reproduction, phonograph recording, audiovisual material or any other
material or article from the library without having it charged to
a validly issued library card or unless said person has written permission
from the librarian.
No person shall knowingly register or furnish a false name or
address or use any other library card other than the one issued to
said person for the purpose of borrowing any book or other material
from the library or member library.
The trustees of the library shall adopt and post in a conspicuous
place in the library building rules, regulations and procedures governing
the borrowing of books, periodicals, pamphlets, artistic reproductions,
phonograph recordings, audiovisual materials and any other items available
for borrowing by the public.
No person shall obstruct, annoy, molest, hinder, threaten, insult
or interfere with any library employee or person legally enjoying
the privileges of the library, nor shall any person make any loud,
disturbing or offensive noises or otherwise create a nuisance in and
upon the grounds and premises of the library.
The Library Director or agent otherwise designated by the trustees of the library is authorized to file a complaint in the Municipal Court after the terms of §
324-2 of this chapter have been met.
Any person who violates or fails to comply with the provisions
of this chapter shall, upon conviction thereof, be subject to a fine
not to exceed $500.
