A. 
As used in this article, the following terms shall have the meanings indicated:
MUNICIPAL GOVERNMENT BUILDING
A building or a portion of a building owned or leased by the Town of Belvidere.
SMOKE or SMOKING
The burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco.
SUPERVISOR
The person(s) who ultimately control(s), govern(s) or direct(s) the activities and conduct of employees of the Town of Belvidere.
B. 
It is the intention of this article to comply with the provisions of N.J.S.A. 26:3D-47.[1]

No person shall smoke or carry a lighted cigar, cigarette, pipe or other lighted matter or substance which contains tobacco in any municipal government building, as defined herein.
A. 
The primary enforcement authority for this article shall be the Board of Health of the Town of Belvidere and the local Health Officer or other individual designated by the Town Council.
B. 
Any member of the public who smokes in a government building in violation of this article is subject to a fine not to exceed $25. The fine shall be enforced and collected by a summary proceeding in accordance with the Penalty Enforcement Law (N.J.S.A. 2A:58-1 et seq.).
C. 
Any supervisor, as defined herein, shall have the right to withhold the services of the supervisor's department, division or agency to any member of the public who smokes in any municipal government building, provided that the Supervisor shall first inform that person of this right. Services shall not be denied if the member of the public complies with the rules governing smoking after receiving this notice.
D. 
In addition to the foregoing, all violations of this article shall be handled in accordance with the enforcement provisions of N.J.S.A. 26:3D-51.[1] The Municipal Court of the Town of Belvidere shall have jurisdiction over proceedings to enforce and collect any penalty imposed because of a violation of any provision of this article if the violation has occurred within the territorial jurisdiction of the Court.

No person shall smoke or carry a lighted cigar, cigarette, paper or other lighted matter or substance which contains tobacco in any rooming house, as defined in § 505-2 of the Town Code.
A. 
This article may be enforced by complaint of the Board of Health of the Town of Belvidere, by the local health officer or other individual designated by the Town Council, or by the owner, operator or manager of the rooming house.
B. 
Any person who is found to be in violation of this article shall be subject to the fine established in § 416-3B of the Town Code. The Municipal Court of the Town of Belvidere shall have jurisdiction over proceedings to enforce this article and to collect any penalty imposed therein.
