The following words, when used in this chapter, shall have the meanings ascribed to them in this section, except in those instances where the context clearly indicates otherwise:
APPLICANT
Any person who makes application for a permit. For the purposes of this chapter, any public utility company or municipal authority required to obtain a permit shall be considered the applicant. An application shall not be submitted in the name of contractors of the public utility company or municipal authority.
EMERGENCY
Any unforeseen circumstances or occurrence, the existence of which constitutes a clear and immediate danger to persons or properties.
ENGINEER
The duly appointed City Engineer of the City of Latrobe or its authorized representative.
EXCAVATION
Any activity within the right-of-way of any street, which involves cutting, breaking, crossing (either laterally or longitudinally), drilling, grading, digging, or disturbing the earth or other material making up the surface or subsurface of any street. In this chapter, term "opening" shall have the same meaning as "excavation."
MANAGER
The Manager of the City of Latrobe or his authorized representative, including, without limitation, the Code Enforcement Officer or the Director of Public Works.
MUNICIPALITY
The City of Latrobe.
NEWLY IMPROVED STREET
Newly constructed and/or improved street, including base and surfacing of either concrete or asphalt and reconstructed streets surfaced with at least a one-and-one-quarter-inch top of asphalt. It shall be the prerogative of the Director of Public Works to define the category of "newly improved street" and advise the proper utility companies of this designation.
PERMITTEE
Any applicant who has been issued a permit and has agreed to fulfill all the terms of this chapter.
PERSON
Any natural person, partnership, firm, association, corporation or municipal authority.
PUBLIC UTILITY COMPANY
The Latrobe Municipal Authority (LMA) or any company subject to the jurisdiction of and control by the Pennsylvania Public Utility Commission.
STREET
A public street, public easement, right-of-way, public highway, public alley, public way or public road accepted or maintained by the municipality or open for travel and use by the public, whether or not so accepted or maintained, including the entire area within the right-of-way thereof.
