It shall be unlawful for any person to throw, place or deposit any trash, garbage, rubbish, ashes, refuse or other foreign material upon any sidewalk, crosswalk, avenue, street, lane, alley, park or other public place within the Town or upon any property owned by the Town; or upon any property over which the police powers of the Town extend, except as provided in this article or the rules and regulations adopted pursuant hereto.
A. 
Unless the context specifically indicates otherwise, the meaning of terms used in this article and the rules and regulations adopted pursuant hereto shall be as follows:
DWELLING UNIT or HOUSEHOLD
A structure or that part of a structure which is used as a home, residence or sleeping place by one person or by two or more persons maintaining a common household to the exclusion of all others.
MAYOR AND TOWN COUNCIL
The group of duly elected officials.
PERSON
An individual, firm, company, association, society, corporation or group.

"Shall" is mandatory; "may" is permissive.
A. 
The provisions of this article shall apply to all dwelling units. All dwelling units shall be charged at the rate set forth by Mayor and Council.
B. 
Not included in this rate is the cost of container service or more than one pickup per week. The container shall be the property and the responsibility of the property owner.
C. 
Billing shall be in connection with the electric bill submitted to each person receiving electric service, including electric services disconnected for nonpayment.
D. 
All monies collected shall be deposited into the general fund. All expenses involved in connection with trash service shall be paid from this fund.
E. 
Unpaid charges shall become a lien against the property.
The charge shall be payable and billed monthly.

Any person, firm, partnership, association or corporation, or any organized group of persons who or which shall fail to pay the trash collection charge assessed in accordance with § 142-4 above, for a period of 30 days, shall be assessed a late charge equal to 6% of the most current trash account balance. In addition, trash service may be discontinued until such time as this bill is paid in full. Unpaid charges shall become a lien against the property.
Any person violating any provision of this article, and upon conviction thereof before any court of competent jurisdiction shall be fined $100 per day of each separate violation.
