Any person, company, corporation or any other entity must obtain a "Miss Utilities" ticket or number prior to the commencement of any digging, boring or excavation in the Town of Middletown.
The penalties for failure to obtain a "Miss Utilities" ticket or number are as follows:
A. 
First offense: a penalty of $250, which must be paid before any work is resumed.
B. 
Second offense: a penalty of $1,000, which must be paid before any work is resumed.
C. 
Third offense: a penalty of $1,000, and violator is banned from doing any further work in the Town of Middletown.
Any person, company, corporation or any other entity must obtain a permit from the Town of Middletown prior to any digging or boring under any road or street in the Town of Middletown. A penalty of $5,000 will be imposed if a permit is not obtained. The penalty must be paid before work may be resumed.
When the Town of Middletown issues a stop-work order, work must cease immediately, and failure to do so is subject to the imposition of a penalty of $5,000 for each and every day that work continues after the issuance of the stop-work order.
