§ 110-1 Conformance required.

All installations, renewing, extending or altering of electric wiring for light, heat or power, in or on any building or structure, outdoor commercial display or sign in Ventnor City, New Jersey, shall conform to the provisions of the current edition of the electrical code as promulgated by the Commissioner of Community Affairs pursuant to the Uniform Construction Code Act (N.J.S.A. 52:27D-119 et seq.).

§ 110-2 Word usage.

Whenever any word in any section of this chapter importing the plural number is used in describing or referring to any matters, parties or objects, any single matter, party, person or object shall be deemed to be included where the context of said chapter permits the same, although distributive words may not have been used. When any subject matter, party or object is referred to in this chapter by words importing the singular number only, several matters, parties, persons or objects shall be deemed to be included where the context of said chapter permits the same. Words in the present shall be deemed to include the future, and words in the future shall be deemed to include the present where the context of the chapter shall so permit.

§ 110-3 Permit required.

Before any person, firm or corporation, which shall include homeowners as herein described and state-licensed electrical contractors, shall install, renew, extend or alter any electric wiring, fixed electric appliances or electrical material or unit, they shall first apply for and obtain a permit from the Electrical Bureau of the City of Ventnor City for each electrical installation, renewal, extension or alteration. Such a permit shall be issued by the Electrical Subcode Official of the City of Ventnor City and only to state-licensed electrical contractors or homeowners as herein described. All applications shall be on permits or forms supplied by the Electrical Subcode Official of the City of Ventnor City.

§ 110-4 Inspections.

The inspections under this chapter shall be administered by the Electrical Subcode Official in accordance with the rules and regulations in the current edition of the electrical code as promulgated by the Commissioner of Community Affairs pursuant to the Uniform Construction Code Act (N.J.S.A. 52:27D-119 et seq.). Said Electrical Subcode Official, upon request, shall during the installation of an electrical system, wiring or unit, make or cause an inspection to be made to assure compliance with the electrical code, and he shall make or cause to be made a reinspection of any electric installation whenever he deems it necessary in the interest of public safety. All permits are to be consecutively numbered. Any permits completed in error shall be retained and marked "void" and retained by the Electrical Subcode Official for his files.

§ 110-5 Authorization to stop work.

The Electrical Subcode Official and the Building Subcode Official or, in the absence of said Subcode Officials, the Chief of Police, any member of the Police Department or any person designated by a resolution of the Board of Commissioners of the City of Ventnor City is hereby authorized to stop electrical work from proceeding on said job when the City of Ventnor City has been notified by the Electrical Subcode Official that such work is not being corrected and is being installed in violation of the standards as specified in the current edition of the electrical code.

§ 110-6 Payment of costs.

The cost of the permit shall be as set forth in § 110-12. All checks are to be made payable to the Electrical Bureau, City of Ventnor City, New Jersey.

§ 110-7 Work by licensed electrician or homeowner; inspections.

It is hereby declared illegal for anyone to use an electrical permit to do electrical work in Ventnor City except a state-licensed and bonded master electrician or a homeowner. A "homeowner" is defined as a person who is the legal title holder to property situated in the City of Ventnor City used as a single-family dwelling by this owner's immediate family. A homeowner may repair or replace the electrical wiring in his own home, but if he has assistance of any nature, that assistance must be provided by a person who is a state-licensed electrical contractor. When a homeowner has completed the work, he shall immediately apply to the Electrical Subcode Official for an inspection by him, and the homeowner shall repair or replace any wiring found by said Subcode Official to be in violation of the standards for wiring or safe installation.

§ 110-8 Defective systems in public building.

If an existing electric wiring system of any public building, upon inspection, is found to be defective and unsafe, upon notification by the Electrical Subcode Official, such system shall be discontinued until it has been corrected and made to conform to the requirements of the current edition of the electrical code and approved by the Electrical Subcode Official.

§ 110-9 Provisions not to conflict with statute.

The provisions of this chapter are in no way to conflict with the state statutes, in particular N.J.S.A. 45:5A-18, "Work not included within the business of electrical contracting," nor with any of their amendments.

§ 110-10 Approved materials.

Only the materials, fittings and devices enumerated in the List of Approved Appliances of Underwriters' Laboratories, Inc., as revised from time to time, shall be used under this chapter.

§ 110-11 Responsibility for damages.

This chapter shall not be construed to affect the responsibility of any party owning, operating, controlling or installing any electrical equipment for damages to persons or property caused by any defect therein; nor shall the City of Ventnor City or any of its officers or officials be held to assume any such liability by reason of the inspection or the reinspection authorized herein or the certificate of approval issued as herein provided or by reason of the approval or disapproval of any equipment authorized herein.

§ 110-12 Fees.

§ 110-13 Violations and penalties.

Violators of this chapter shall be subject to punishment by a fine of not more than $1,000 and/or by imprisonment for not more than 90 days, if found guilty of a complaint in the Municipal Court of the City of Ventnor City, New Jersey. In addition to or as a substitute for the previously mentioned fine, the imposition of community service shall be authorized as an additional penalty, which community service shall not exceed 90 days.
