A. 
As a condition for approval of the SWM site plan and report, the applicant shall provide a financial security to the municipality for the timely installation and proper construction of all stormwater management facilities approved by the SWM site plan and report, equal to 110% of the full construction cost of the required controls in accordance with the provisions and requirements of the Pennsylvania Municipalities Planning Code.
B. 
At the completion of the project and as a prerequisite for the release of the financial security, the applicant shall:
(1) 
Provide a certification of completion from a qualified professional verifying that all permanent facilities have been constructed according to the SWM site plan and report and approved revisions thereto.
(2) 
Provide a set of record drawings for stormwater management facilities to be dedicated to the municipality, or, when requested by the municipality, for BMPs to be privately owned.
(3) 
Request a final inspection from the municipality to certify compliance with this chapter, after receipt of the certification of completion and record drawings by the municipality.
A. 
The municipality, the Municipal Engineer, and/or the municipality's designee may inspect all phases of the installation of temporary or permanent stormwater management facilities.
B. 
During any stage of construction, if the municipality determines that the stormwater management facilities are not being installed in accordance with the approved SWM site plan and report, the municipality shall notify the applicant, and the applicant shall take action to address the issue. The municipality may suspend or revoke any existing permits or approvals until the matter is addressed. In addition, the municipality may require the applicant to submit a revised SWM site plan and report for review and approval as specified in this chapter.
C. 
After completion of construction, stormwater management facilities shall be inspected by the landowner, or the landowner's designee, according to the inspection schedule described on the approved SWM site plan and report.
D. 
The municipality, the Municipal Engineer and/or the municipality's designee may also conduct inspections of the stormwater management facilities.
E. 
The costs for such inspections shall be reimbursed by the developer per the provisions of § 112-46 of this chapter.
A. 
Upon presentation of proper credentials, the enforcement officer and any other duly authorized representatives of the municipality may enter at reasonable times, upon any property within the municipality, to inspect the construction or operations and maintenance of the stormwater management facilities regulated by this chapter. Landowners shall provide persons working on behalf of the municipality with access to all parts of the premises for the purposes of determining compliance with this chapter.
B. 
Persons working on behalf of the municipality shall have the right to temporarily locate on any stormwater management facility in the municipality such devices as are necessary to conduct monitoring and/or sampling of the performance of the facility.
C. 
Failure to allow the municipality access to regulated stormwater management facilities is a violation of this chapter.
