In order to establish a more harmonious and cooperative relationship between the village government and complainants alleging handicapped discrimination, it is hereby declared that the settlement of certain differences between persons complaining of handicapped discrimination and the village government will be settled through the following procedures under which such complainants may present grievances, free from coercion, interference, restraint, discrimination or reprisal. The provisions of this procedure shall be liberally construed for the accomplishment of this purpose.
As used herein, the following terms shall have the following meanings:
GOVERNMENT
The Village of Lowville, New York.
GRIEVANCE
Any claimed violation, misinterpretation or inequitable application of Department of Treasury Office of Revenue Sharing rules, procedures and regulations as contained in Office of Revenue Sharing regulation, 31 CFR Part 51, relating to financial assistance to state and local governments and discrimination on the basis of handicapped and any other complaints alleging handicapped discrimination.
HANDICAPPED INDIVIDUAL
Any person who has a physical or mental impairment that substantially limits one or more major life activities, has a record of such an impairment or is regarded as having such an impairment.
Every handicapped individual shall have the right to present his or her grievance to the government in accordance with the provisions set forth herein, free from interference, coercion, restraint, discrimination or reprisal.
A. 
Every handicapped person who claims to have a grievance in relation to the rules and regulations as set forth in the Department of the Treasury, Office of Revenue Sharing, 31 CFR Part 51, shall present his or her grievance in writing to the Clerk of the Village of Lowville within 10 days after the grievance occurs.
B. 
The Clerk of the Village of Lowville shall discuss the grievance with the handicapped individual and make such investigation as appropriate and shall consult with the Superintendent of the Village of Lowville to such extent as appropriate, all on an informal basis.
C. 
After the investigation, if any, the Clerk of the Village of Lowville shall then present the grievance and the results of said investigation to the Mayor and Board of Trustees of the Village of Lowville at the next regular Village Board meeting.
D. 
The Mayor and Board of Trustees of the Village of Lowville shall then consider the grievance at that meeting or at an adjourned meeting and if necessary, shall communicate with the handicapped individual so that a hearing can be held with said handicapped individual and the Mayor and Board of Trustees at the next regular Village Board meeting.
E. 
After consideration by the Mayor and Board of Trustees of the grievance as presented and at the close of the hearing in the event that the same is held and within 10 days thereafter, the Mayor and Board of Trustees shall render their decision and communicate the same to the handicapped individual.
F. 
The grievance presented by the handicapped individual shall be in writing and shall contain a statement as to the specific nature of the grievance and the facts relating to it.
The time limitations for presentation and resolution of grievances, as hereinbefore fixed, may be waived and extended by mutual agreement of the parties involved.
