This chapter shall be known or may be cited by the title of "Planning Commission Ordinance of the Borough of Marcus Hook."
Creation.
A. 
The Borough of Marcus Hook hereby creates a Planning Commission consisting of three members, one of whom shall be designated to serve until the first day of January 1982, one until the first day of January 1983 and one until the first day of January 1984. Their successors shall be appointed on the expiration of their respective terms, to serve four years. The members of the Commission shall be removable for cause, by the appointing authority, upon written charges and after public hearing. Vacancies shall be filled for the unexpired term of any member whose term becomes vacant.
B. 
Two additional members shall be appointed to the Planning Commission, so that it shall have a total membership of five. The initial terms of these members shall be for such periods that not more than two members of the Commission shall be reappointed or replaced during any calendar year. The successors to these members shall be appointed for terms of four years.

The Planning Commission shall adopt rules in accordance with the provisions of this chapter the Pennsylvania Municipalities Planning Code.[1]

Meetings of the Commission shall be held at the call of the Chairman and at such other times as the Commission may determine. The Chairman, or in his absence, the Acting Chairman, may administer oaths and compel the attendance of witnesses. All meetings of the Commission shall be open to the public. The Commission shall keep minutes of its proceedings, showing the vote of each member upon each question, or if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions, all of which shall be immediately filed in the office of the Commission and shall be a public record.
The Commission shall give public notice of all meetings, as well as due notice to any party in interest.
The Commission shall have the following powers and duties:

Prepare the comprehensive plan for the development of the Borough of Marcus Hook as set forth in the Pennsylvania Municipalities Planning Code[1] and present it for the consideration of Borough Council.

B. 
Maintain and keep on file records of its actions. All records and files of the Planning Commission shall be in the possession of Borough Council.
C. 
The Planning Commission, at the request of Borough Council, may:
(1) 
Make recommendations to the Borough Council concerning the adoption or amendment of an official map.[2]

Prepare and present to Borough Council a zoning ordinance and make recommendations to Borough Council on proposed amendments to it as set forth in the Pennsylvania Municipalities Planning Code.[3]

(3) 
Prepare, recommend and administer subdivision and land development and planned residential development regulations as set forth in the Pennsylvania Municipalities Planning Code.[4]

(4) 
Prepare and present to Borough Council a building code and a housing code and make recommendations concerning proposed amendments thereto.[5]

(5) 
Do such other acts or make such studies as may be necessary to fulfill the duties and obligations imposed by the Pennsylvania Municipalities Planning Code.[6]

(6) 
Prepare and present to Borough Council an environmental study.
(7) 
Submit to the Borough of Marcus Hook a recommended capital improvements program.
(8) 
Promote public interest in and understanding of the comprehensive plan and planning.
(9) 
Make recommendations to governmental, civic and private agencies and individuals as to the effectiveness of the proposals of such agencies and individuals.
(10) 
Hold public hearings and meetings.
(11) 
Require from other departments and agencies of Marcus Hook, Delaware County and Commonwealth of Pennsylvania, as well as federal agencies, such available information as relates to the work of the Planning Commission.
D. 
In the performance of its functions, the Commission may enter upon any land to make examinations and surveys with the consent of the owner.
E. 
In the performance of its powers and duties, any act or recommendation of the Planning Commission which involves engineering considerations shall be subject to review and comments of the Borough Engineer, which shall be incorporated and separately set forth in any report, written act or recommendation of the Planning Commission.
