A certain document, three copies of which are on file in the office of the Manager/Secretary of the Borough of Marcus Hook, Delaware County, Pennsylvania, being marked and designated as the "International Property Maintenance Code, 2009 Edition," as published by the International Code Council, and utilized by the Pennsylvania Uniform Construction Code be and is hereby adopted as the Property Maintenance Code of the Borough of Marcus Hook, Delaware County, in the State of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Borough of Marcus Hook are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 157-10 of this article.
The following sections of the International Property Maintenance Code, 2003, are hereby revised as follows:
A. 
Section 101.1. Insert: "The Borough of Marcus Hook, Delaware County, Pennsylvania."
B. 
Section 103.5. Fees. Replace with: "Fees for activities and services performed under this code shall be established from time to time by resolution."
C. 
Section 111.1. Application for appeal. Delete the first sentence and add: "Any person shall have the right to appeal a decision of the code official to the Council of the Borough of Marcus Hook. An application for a special hearing may be made in writing to the Manager/Secretary's office within 20 days of the time the notice was served."
D. 
Section 111.2. Membership of the Board. Replace with: "For the purpose of this article, the word 'Board,' wherever it may appear in this code, will be defined as meaning the Council of the Borough of Marcus Hook."
E. 
Section 111.2.1 through 111.2.5 are hereby deleted.
F. 
Section 111.3. Notice of meeting. Change the word "Chairman" to the words "President of Council."
G. 
Section 111.5. Postponed hearing. Delete.
H. 
Section 302.4. Insert: "six inches."
I. 
Section 304.14. Insert: "April through September."
J. 
Section 602.3. Insert: "October through April."
K. 
Section 602.4. Insert: "October through April."
A. 
The following provisions are hereby added to the International Property Maintenance Code, 2003. In Chapter 3, entitled "General Requirements," Section 309 is added to read as follows:
Section 309.1. Caretaker. In every multiple dwelling in which the owner does not reside there shall be a responsible person, designated by the owner, residing on the premises, whose duties include maintaining the commonly used parts of the premises, or there shall be provided in a noticeable location a placard in good condition and enclosed in plastic or glass stating the name of the management and a phone number or numbers where the responsible person or persons can be reached at all hours. Such placard shall be placed adjacent to elevators and exitways. The intent of this section may also be served if each tenant is provided in written legible form this same information.
