The Borough Council of the Borough of Marcus Hook recognizes the Delaware County Land Development and Subdivision Ordinance of 2016, and thereafter amended, has legal jurisdiction and is being enforced within the incorporated boundaries of Marcus Hook, Delaware County.[1]

Editor's Note: A preamble to this chapter stated that the Pennsylvania Municipalities Planning Code establishes the basic authority for the exercise of municipal land use controls by Pennsylvania municipalities; that the Planning Code enables local governments to govern community development through zoning and subdivision and land development ordinances; that Article V, Section 502 of the Planning Code (53 P.S. § 10502), provides for the governing bodies of counties to enact subdivision and land development ordinances having jurisdiction in cities, boroughs, incorporated towns and townships within the county which have no such ordinances in effect at the time a subdivision of land development ordinance is introduced in the county; that such an ordinance had been adopted by Delaware County in 1978 and amended in 1981; and that Delaware County had adopted a resolution establishing a fee schedule for land development and subdivision review.
The Borough of Marcus Hook adopts by reference Delaware County Resolution 7601 as amended in 1985, and further amended in 1989, known as the "Delaware County Fee Schedule for Subdivision and Land Development Reviews," to help defray the cost of subdivision and land development reviews by the Borough of Marcus Hook, to remain applicable and consistent with the Delaware County Fee Schedule as currently written and as modified or amended, by authority of the Pennsylvania Municipalities Planning Code of 1968, Act 247, as amended by Act 194 of 1974 and Act 170 of 1988.
