The Borough of Newfield does, by this article, adopt certain environmental controls over garbage, rubbish, trash and other paper products, as well as certain metals, the collection of the same and the separation of paper and paper products from other forms of trash and garbage. The intent of this article is to permit recycling or recovery, to provide for an environmentally sound approach to the separation of paper and paper products, as well as the salvage and reuse of certain metals and to provide for fines and penalties for those who violate the chapter. Any part of this article found to be unconstitutional and/or illegal shall be invalidated; however, the remaining provisions of this article shall not be invalidated by such determination.
For the purpose of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
ALUMINUM
All products made of aluminum cans, foil, wrappers, containers for prepared dinners or other foods, screen frames and lawn chairs.
CANS
All containers comprised of aluminum, metal, tin, steel or a combination thereof which contain or formerly contained only nonaerosol compatible substances or such other substances as have been approved for recycling by the New Jersey Office of Recycling.

GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter and all other material commonly known as "glass," excluding, however, blue and flat glass, ceramics, pottery and glass commonly known as "window glass."
NEWSPAPER
A publication made of newsprint and sold or distributed at stated intervals, customarily containing and having as its primary purpose newsworthy items or advertisements or any other matters of public interest and shall not be construed to mean any magazine or periodical or other paper products of any nature whatsoever.
PAPER AND PAPER PRODUCTS
Includes the following categories:

A. 
Newspaper. Paper of the type commonly referred to as "newsprint" and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest.
B. 
Magazines.
C. 
Corrugated cardboard. Only double-layer brown cardboard with an inside waffle layer. No pizza, shoe, gift or cereal boxes; no packing materials, plastic foam, tape or food; no waxed or yellow cardboard.
D. 
High-grade white office paper. Stationery, notepad, copier paper, forms, computer paper and tab cards.
PLASTICS
Includes containers comprised of durable material made from various resins which contain or formerly contained milk, water, fruit juices, soda, household cleaners, detergents and bleach.

The following categories of mandatory separation are hereby established:
A. 
Paper.
B. 
Glass.
C. 
Aluminum, cans, pans, foil.
All of the aforementioned items shall be placed in separate containers to be collected in accordance with this article, and the Borough shall, from time to time, promulgate rules and regulations for the enforcement of the same.
A. 
It shall be the duty of every person who occupies or is in possession of any property in the Borough of Newfield, in the County of Gloucester, except for persons who have made other arrangements for legal disposal as hereinafter set forth, to dispose of all solid waste accumulated on or generated on said property as follows:
(1) 
To separate all glass, aluminum and paper from all other such solid waste.
(2) 
To place all separated glass in lots of not more than 50 pounds each in waterproof containers suitable for transportation.
(3) 
To place all separated aluminum in lots of not more than 50 pounds each in waterproof containers suitable for transportation.
(4) 
To place all separated paper in bundles of not more than 50 pounds each in waterproof containers suitable for transportation.
(5) 
To transport to, deliver and dump all of such separated glass, aluminum and such separated paper in the Borough's collection bins, dumpsters or other receptacles, located at areas to be designated from time to time by Borough Council, between the hours of 8:00 a.m. and 4:00 p.m. on all days of the week, including Saturdays, but excluding Sundays and holidays.
(6) 
The foregoing provisions of this section shall not apply to the occupants or persons in possession of any property who may choose other means of legally disposing of glass, aluminum and/or paper accumulated or generated at such property.
(7) 
To place all the remainder of such solid waste, except such articles and things as are hereinafter enumerated, in lots of not more than 50 pounds each in metal, plastic or rubberoid type trash or garbage containers or in plastic bags of sufficient strength to permit handling in the ordinary course of collection and to set such containers or bags out in front of the property on which the solid waste was accumulated or generated between the sidewalk and curb along public streets or along the roadside of public roads within such hours and on such days as may be established for collection; except and excluding from this provision the following articles and things:
(a) 
Discarded articles and things too large for packaging or handling; such as household appliances, furniture and furnishings, automobiles, other vehicles and machines.
(b) 
Materials left over from building construction, demolition or renovation.
(c) 
Discarded agricultural products and animal waste resulting from agricultural enterprises in the Borough.
(d) 
Discarded industrial products and debris resulting from commercial and industrial enterprises in the Borough.
(e) 
Any and all solid waste removed and legally disposed of by accommodation arrangements with any person or by contract arrangement with any person engaged in the business of solid waste collection and removal.
(f) 
Solid waste of any kind removed and legally disposed of by the owner, occupant or person in possession of any property in the Borough, including but not limited to glass and paper.
B. 
The occupant and/or owner of any building within the Borough of Newfield who shall place for disposal, removal or collection of the following named items shall do so in strict conformity with the following added regulations:

(1) 
Method of placing commingled materials. All cans, glass and plastics shall be co-mingled and placed in containers, galvanized or plastic composition not exceeding 30 gallons or 60 pounds when filled. Said containers shall have two sturdy handles.
(2) 
Method of placing paper and paper products.
(a) 
Newspapers. Cross-tie securely with string or twine in bundles no higher than one foot.
(b) 
Magazines. Place a few magazines in with newspaper bundles no higher than one foot. The bundles must be tied.
(c) 
Corrugated cardboard. Flatten boxes and tie in bundles with twine or bale.
(d) 
Office paper. Place in a brown paper bag.
No person shall take, remove or scavenge any recyclable solid waste from any place in the Borough or from any property in the Borough without the permission of the occupant or person in charge of the property from which the recyclable solid waste is removed.
No person shall dump or deposit any solid waste of any kind whatsoever accumulated or generated outside of the Borough in any bin, dumpster or other receptacle maintained by the Borough for use in collection, deposit or storage of any kind of solid waste whatsoever.
A. 
The Borough Council may from time to time by resolution formulate and adopt rules and regulations consistent with the provisions of this article for the separation, collection and removal of both recyclable and nonrecyclable solid waste and for the administration of this article and may provide that such rules and regulations shall be administered by the Borough's Sanitation and Maintenance Committee. Such resolution may further provide for the appointment of an advisory committee composed of seven citizens of the Borough to include the Mayor, Chairman of the Sanitation and Maintenance Committee, the Public Works Supervisor and Chairman of the Environmental Committee, to study and advise on possible improvements of the Borough Council's rules and regulations and on ways and means of improving the Borough's system of collection, marketing and sale or other disposition of all kinds and categories of solid waste.
B. 
The collection of all recycled products and materials as described herein shall be at such times to be designated by the Borough Council.

From time of placement at the curb by any one of the categories as described herein for collection by the Borough of Newfield in accordance with the terms hereof, items shall be and become the property of the Borough of Newfield or its authorized agent. It shall be a violation of this article for any person unauthorized by the Borough of Newfield to collect or pick up or cause to be collected or picked up any such items. Any and each such collection in violation hereof from one or more residences shall constitute a separate and distinct defense punishable as herein after provided.

Any person that violates or neglects to comply with any provisions of this article or any regulation promulgated pursuant thereto shall upon conviction thereof be punishable by a fine not to exceed $2,000, by imprisonment for a term not exceeding 90 days, or a period of community service not exceeding 90 days.

The foregoing provisions of this ordinance[1] shall not apply to the occupants or persons in possession of any property who may choose other means of legally disposing of glass, aluminum and/or paper products accumulated and generated as such property.

Any business operating in the municipality that recycles its own materials shall submit a tonnage report to the Recycling Coordinator on or before March 1 of each year for each month of the preceding year.

It shall be the duty of every person, commercial and/or industrial enterprise in the Borough of Newfield acquiring a construction or demolition permit for the use of or demolition of asphalt, concrete, brick and wood waste to complete a recycling verification form provided by the Recycling Coordinator of the Borough of Newfield ensuring that the aforesaid materials are recycled by a certified recycler.
